CONTROL OF IMPORTATION REGULATIONS

2. In these regulations, unless the context otherwise
requires-
"Comptroller of Customs" includes any officer of the Customs
Department who from time to time is authorised by the Comptroller
of Customs to act for him in carrying out the provisions of
regulation 10;
"goods" means articles of any description, both used and unused,
but does not include books, periodicals and newspapers which are
imported into these Islands through the post;
"importation" means the bringing of goods into these Islands
from any other place, by whatever means the carriage is effected;
"Minister" means the Minister responsible for Trade Matters and
includes, to the extent of the authority given, any person authorised
by the Minister in that behalf for any purpose of these regulations.
Prohibition of 
importation.
3. Subject to the provisions of these regulations, the
importation of all goods into these Islands is prohibited.

4. Nothing in regulation 3 shall be taken to prohibit the
importation of any goods under the authority of any licence granted
by the Minister under this regulation, provided that all conditions
attaching to the licence are complied with.

5. (1) An open general licence is granted for the importation
into these Islands of goods of any description not included in the
Schedule to these regulations, if they do not originate in a country
or countries against which the Security Council of the United
Nations would have imposed any restrictions regarding imports
therefrom under Chapter VII of the United Nations Charter.
(2) For the purposes of sub-regulation (1), the Director shall by
notice in the Gazette publish from time to time a reference to any
resolution to which the said sub-regulation applies.
(3) Notwithstanding the provisions of any other regulation, the
importation into these Islands of any goods landed for transhipment
to a destination, where the exportation of such goods to such
destination is prohibited in terms of regulation 4 of the Exportation
(Control) Regulations, is prohibited.
(4) Notwithstanding the provisions of the foregoing sub-
regulations the importation of any article or other thing made,
manufactured, duplicated or otherwise reproduced or copied in
violation of the rights of copyright enjoyed by any person and
protected by Maltese law is hereby prohibited and no licence shall
be issued for such importation.

6. Applications for the grant of licences for the importation of
goods or for the extension of time for the purposes of these
regulations shall be made in such form and contain such particulars
as the Minister may, from time to time, determine and shall each
bear stamps to the value of two cents and five mils.
Licences.

7. (1) The Minister may, in his discretion, refuse the grant of
a licence or, in granting it, impose such conditions as he may deem
proper, in either case without assigning any reason therefor.
(2) The Minister may, in his discretion, at any time revoke or
modify any licence previously granted by him, without assigning
any reason for the revocation or modification.
Where licence 
ceases to have 
effect.
8. A licence issued under these regulations shall cease to have
effect and any goods purported to have been imported thereunder
shall be deemed to have been imported without a licence- 
( a ) if the order for the goods is not definitely placed
within one month from the date of the issue of the
licence; or 
( b ) if the goods to which the licence relates are not
shipped within such date as may be specified to that
effect in the licence, or, if no such date has been
specified,  within eight months from the date of the
issue of the licence; or 
( c ) if the goods originate in or are consigned from a
country other than that shown on the licence; or 
( d ) if the licence is used by a person or firm other than the
one shown on the licence; or
( e ) if the price per unit of measure, or, as the case may be,
of weight at which the goods are imported exceeds the

price shown on the licence.
Extension of 
periods.

9. The Minister may, in his discretion on an application
extend any of the periods mentioned in or imposed under these
regulations.
Delivery of licence 
on importation.

10. On the importation of the goods to which the licence
relates, or of part thereof, the holder of the licence shall deliver the
licence to the Comptroller of Customs who shall cancel it:
Provided that nothing in this regulation shall be taken to
prohibit the issue by the Minister in  bona fide  cases of part
importation of the goods of a fresh licence under regulation 4 to
cover the outstanding balance of the goods.
Exemption.
as they are inconsistent with any international agreement,
arrangement or understanding to which the Government is a party.
Penalties. 
Regulations shall be guilty of an offence and shall, on conviction
by the Court of Magistrates (Malta) or the Court of Magistrates
(Gozo) as a Court of Criminal Judicature -
( a ) when the value of the goods which have been
imported, or in respect of the importation of which an
attempt or a preparatory act has been made, does not
exceed twenty liri, to a fine ( multa ) of not less than ten
liri but not exceeding fifty liri; 
( b ) when the value of the goods which have been
imported, or in respect of the importation of which an
attempt or a preparatory act has been made, exceeds
twenty liri but does not exceed five hundred liri, to a
fine ( multa ) of not less than one hundred liri but not
exceeding five hundred liri or to imprisonment for a
term not exceeding three months or to both such fine
and such imprisonment;
( c ) when the value of the goods which have been
imported, or in respect of the importation of which an
attempt or a preparatory act has been made, exceeds
five hundred liri, to a fine ( multa ) of not less than two
hundred liri but not exceeding one thousand liri or to
imprisonment for a term not exceeding six months or
to both such fine and such imprisonment,
and in all cases the Court shall moreover order the forfeiture of the
goods to which the offence relates, even though the owner thereof
may not be a party to the proceedings.
False statements, 
etc.
13. If, for the purposes of obtaining a licence under these
regulations, any person makes any statement or furnishes any
document or information which to his knowledge is false in a
material particular or recklessly makes any statement which is false
in material particular, he shall be guilty of an offence and shall be
liable, on conviction by the Court of Magistrates (Malta) or the
Court of Magistrates (Gozo) as a Court of Criminal Judicature, to a
fine ( multa ) not exceeding five hundred liri or to imprisonment for

a term not exceeding six months, or to both such fine and such
imprisonment; and any licence which nay have been granted in
connection with the application for which the false statement was
made or the false document or information was furnished shall be
void as from the time when the licence was granted.
