POLICE LICENCES REGULATIONS

2. In these regulations, unless the context otherwise requires -
"battery driven electric moped" means a heavily built motor
bicycle with pedals and an engine whose power output does not
exceed 0.373kW;
"Commissioner" means the Commissioner of Police;
"goods carrying motor vehicle" means a vehicle of any class or
description other than a public service vehicle, used exclusively for
the conveyance of goods or materials. This category of vehicles
includes all kinds of lorries, trucks, vans, tankers, motor hearses
and self loading vehicles;
"gross combined weight (g.c.w.)" means the aggregated sums of
the gross vehicle weight of the motor vehicle used for traction and
the gross vehicle weight of the coupled (by means of a special
coupling device) trailer and, or semi-trailer together with its
maximum specified load;

"gross vehicle weight (g.v.w.)" has the same meaning as is
assigned to it in the Motor Vehicle Roadworthiness Test
Regulations;

Act;
"motor-car" means any vehicle propelled by mechanical power;

"public service vehicle" has the same meaning as is assigned to it
in the Motor Vehicle Roadworthiness Test Regulations;
"semi-trailer" means a trailer that has wheels only at the rear, the
front end being supported by the towing motor vehicle;
"shop" means any shop, stall, kiosk, store, public-house, inn,
restaurant, eating house, tavern or other place where wares,
merchandise, commodities or other goods are sold, whether by
wholesale or retail, or where any art or trade is carried on;

"special purpose motor vehicle" means a motor vehicle specially
constructed or adapted, equipped with various devices that enable it
to perform certain non-transport functions, that is, the primary
purpose of such a vehicle is not the transport of persons or goods.
This category of vehicles includes -
- motor breakdown lorries;
- motor pump vehicles (for example - fire fighting
vehicles);
- lorries fitted with ladders or elevator platforms and, or
adjustable arm (for example - cherry pickers);
- lorries used for cleaning streets, gutters, etc. (for
example - sweepers, sprinklers and cesspool emptiers);
- spraying lorries of all kinds, whether or not fitted with
heating equipment;
- crane lorries, not for the transport of goods;
- mobile drilling derricks;
- lorries fitted with stacking mechanisms, that is, with a
platform which moves on a vertical support and is
generally powered by the vehicle engine;
- concrete mixer lorries;
- mobile electric generator sets;
- mobile radiological units, clinics and laboratories;
- outside broadcasting units (motor vehicles),
telegraphy, radio-telegraphy or radio-telephony
transmitting and receiving vans, radar vans;
- searchlight lorries;
- mobile kiosks;
- other motor vehicles (excluding motor invalid chairs
or carriages) not specified in other items under the
heading Motor Vehicles of Part 1 of these regulations;
"tractor" means any motor vehicle which is not constructed in
such a manner as to carry itself any load, but is intended for towing
any trailer;
"trailer" means any vehicle without mechanical power of its own
designed to be drawn by a motor vehicle and intended for the
purpose of the carriage of goods.
Form of licence.

3. (1) The Commissioner may direct that licences in any one
or more classes be issued in booklet form and, in the case of each
licence issued in that form, an appropriate entry shall be made
thereon in the case of any renewal or transfer of the licence.
(2)  If a licence is withdrawn or revoked or ceases otherwise to
be operative or is suspended or if its holder is disqualified from
holding it by any Court, it shall be returned to the Commissioner. If
loss or destruction thereof is alleged, the Commissioner may
require the declarant to confirm by means of an affidavit the
statement of loss or destruction.

(3) The Commissioner may direct by notice published in the
Gazette that licences in any one or more classes shall bear a
photograph of the licensee; and in each case in respect of which
such a direction obtains, any person who applies for the issue or
renewal of a licence shall produce a recent and suitable photograph
in duplicate of himself.
Validity of licence.

4. (1) All licences issued or renewed by the Commissioner
shall be valid from the date of issue or renewal, unless some other
date is indicated thereon for such purpose, and all such licences,
with the exception of those mentioned in sub-regulation (3) of this
regulation, shall lapse on the thirty-first day of December of the
year in which they are issued or renewed, subject to renewal in
accordance with any law or regulation applicable to such licences:
Provided that a licence issued in respect of the use of a
motor vehicle and any licence to drive a motor vehicle shall lapse
on such date as is indicated thereon.
(2) Where any licence, other than a licence for the use of a
motor vehicle, is issued or renewed after the first day of January of
any year, the period between the date on which or with effect from
which such licence is issued or renewed and the thirty-first day of
December of that year, unless it is otherwise provided in respect
thereof in these regulations, shall be deemed to be a full year for
the purposes of the payment of any fees prescribed in relation to
such licence in the First Schedule to these regulations.
(3) The following licences shall lapse on the date indicated
thereon:
( a ) licences issued or renewed in respect of one or more
specified dates or periods;
( b ) international driving permits;
( c ) international certificates and fiscal permits in respect
of motor-cars.
(4) For the purposes of securing that the work of renewing
licences will be evenly spread the Commissioner may fix the
periods during which licences of any one or more classes are to be
renewed, and notice of such periods shall be published in the
Gazette.
(5) Any person who renews his licence within the period fixed
by the Commissioner under the last preceding sub-regulation of
this regulation shall not be deemed to have acted without a licence
during the interval between the date of expiry of the last licence
held by him and the last day of the period fixed by the
Commissioner, by reason only that the licence was not renewed
before the date of its expiry.

5. (1) The relevant fees specified in the First Schedule or
Second Schedule to these Regulations shall be levied by the
Commissioner on the issue, renewal or transfer of licences, or in
connection therewith:
Provided that:
( a ) on the issue after the expiration of any quarter of a
year of a licence, in respect of which a fee of more
than fifty cents is leviable and which is neither the use
of a motor vehicle, or a motor vehicle driving licence,
or an international driving permit, or an international
certificate of motor vehicle, or a sporting licence, the
fee leviable in respect of that licence (other than the
fee leviable under the proviso to item 62 of the First
Schedule to these Regulations), shall be reduced by as
many fourths as there are quarters which have expired
since the first day of January of the year then current;
and
( b ) on the renewal of a licence for the use of a motor
vehicle after the expiration of one or more quarters of
a year, the licence fee shall be reduced by as many
fourths as there are quarters which have expired since
the lapse of the previous licence, provided the
licensee, prior to the lapse of the validity of the
licence, informs the Commissioner that the vehicle is
not going to be used on the road during one or more
quarters of the year beginning on the date of the said
lapse and is going to be garaged during the said period
of non-use, and provided also that the said licensee
hands over to the Commissioner the relative certificate
of motor vehicle as well as the number plates of the
relative motor vehicle;
( c ) if the owner of a motor vehicle who does not intend
using such vehicle for one or more quarters fails to
comply with the conditions set out in paragraph ( b ) of
this proviso prior to the lapse of the relative licence
but gives his written notice and complies with the
other said conditions at a later date, and moreover
confirms on oath that he has not made use of the said
vehicle since the lapse of its licence, he shall be bound
to pay that proportionate part of the annual licence as
shall represent the number of quarters from the date of
its lapse to and including the quarter then current but
shall not be liable for the payment of the prescribed
fine if such notice is given not later than one month
immediately after the relative licence had lapsed;
( d ) the fees leviable in respect of item 17 of the First
Schedule to these Regulations shall not leviable where
the Director of Public Works or any officer of the
department of public works duly authorised in writing
by the Director of Pubic Works to act in his behalf,
certifies that the deposit of building or other materials
is being effected as part of works carried out under

contract on behalf of the Government.
(2) On the transfer of a licence from premises in respect of
which that licence is operative (hereinafter referred to as ''the new
premises'') the rental value of which is higher or lower than that of
the former premises, an extra fee shall be levied or, as the case may
be, a refund to the licensee shall be allowed in respect of the
remaining quarter or quarters of the year for which the licence is
valid. Such extra fee or such refund shall be computed in relation to
the difference between the full annual fee leviable on the new
premises immediately before the transfer is effected.
(3) All Consular Officers of the United States of America or of
the Republics of France or Italy who are serving in Malta and the
employees of such Consular Officers shall be exempt from the
payment of any motor-car licence fee. For the purposes of this sub-
regulation:
(i) the words ''Consular Officer'' mean any person
who is granted an exaquatur or provisional or
other authorisation by the authorities
appropriate for that purpose in Malta;
(ii) the words ''employee of a Consular Officer''
mean any consular employee who is not a British
or Maltese-British subject, who is not engaged
in private occupation for gain in the Island of
Malta and its Dependencies, and who is a
permanent employee of the Government of the
United States of America or of the Republics of
France or Italy or, alternatively, was not resident
in Malta and its Dependencies at the
commencement of his employment at the
Consulate.
(4) ( a ) A refund in respect of the licence fee (other than the
fee leviable under the proviso to item 62 of the First
Schedule to these Regulations) for a motor vehicle
shall be allowed by the Commissioner if it is proved to
his satisfaction that that vehicle has been scrapped or
has been stolen and not recovered during the currency
of the relative licence or has been exported and has not
been re-imported during the currency of the relative
licence.
( b ) Any refund as is referred to in paragraph ( a ) of this
sub-regulation shall be of one or more quarters of the
fee paid for the licence which shall correspond to the
complete quarter or quarters of the year or period for
which the licence had been issued during which year or
period the vehicle had been scrapped, stolen or
exported.
(5) The Minister responsible for Police may remit or reduce
any fee specified in the First Schedule to these Regulations.

Licence fee to be 
based on rental 
value of premises.

6. (1) Where the fee in respect of the issue or renewal of a
licence is based on the rental value of any premises, such rental
value shall be ascertained by the Commissioner who, for that
purpose, may require the applicant to produce a declaration signed
by himself and by the landlord or administrator of the premises,
showing the amount of rent payable in respect thereof.
(2) It shall be lawful for the Commissioner to require such
other evidence or to take such other measures at the expense of the
applicant, as he may deem fit, for the purpose of ascertaining such
rental value.
(3) If the applicant makes a false declaration, the licence shall
not be granted or, as the case may be, renewed. If the falsity
becomes known to the Commissioner after the grant or the renewal,
the licence shall be avoided. Any refusal of the grant or renewal or
the voidance of the licence under this regulation shall be without
prejudice to any penalty to which the person making the false
declaration may be liable.
(4) Where only a part of any premises is used for the trade or
business covered by the licence, the rental value of the premises
shall be deemed for the purposes of this regulation to be the rental
value of the part so used only and the relative fee shall be computed
accordingly.
Applications. 7. (1) Applications in connection with licences shall be made
on such forms as may be prescribed by the Commissioner from
time to time, and they shall be signed or marked by the applicant.
(2) Such application shall indicate -
( a ) the name, surname, father’s name, occupation and
place of residence of the applicant, and any other
particular at the discretion of the Commissioner
relative to applicant’s identity;
( b ) the object for which the licence is required including
all relevant particulars thereof;
( c ) where a licence is required in respect of acts which are
to be performed on specified dates or at specified
times or in specified places, the dates, times and places
to be covered by the licence;
( d ) any other detail which may be required under any
particular law for the time being in force or which may
be required by the Commissioner at his discretion.
Conditions. 8. Each licence shall contain any condition under which it is
granted.
Licences to be used 
only by the 
licensee. 
9. (1) Licences shall be personal.
(2) Badges which under these Regulations or under any law are
issued to or are to be worn by licensees shall be personal and may
not be handed over by the licensee to another person nor may they
be used by any person other than the licensee.

Certificate of 
motor vehicle.

10. The Commissioner shall not issue or renew any licence in
respect of a motor vehicle unless there is in force, in respect of that
motor vehicle, a certificate of motor vehicle.
Licences to be kept 
on premises.
11. (1) Licences in respect of a shop shall be constantly kept
on the premises to which they refer and, if they are issued
otherwise than in booklet form, they shall be enframed and
conspicuously displayed in the premises.
(2) Licences in respect of motor vehicles shall be affixed to the
windscreen, and licences in respect of other vehicles shall be
affixed to such part of the vehicle as may be directed by the
Commissioner.
(3) Licences other than those referred to in sub-regulations (1)
and (2) of this regulation shall be constantly carried on his person
by the licensee whenever he is performing the act to which the
licence refers.
(4) All licences shall be produced on demand for examination
by any member of the Police force.
Badge.

12. (1) Drivers of motor cars for hire, bus drivers, bus
conductors, bus ticket-inspectors, cab drivers, market and parcel
post porters, waiters, waitresses, boatmen, artistes, barmaids,
shoeblacks and any other persons who under any law or regulation
are required to wear a distinctive badge shall, during the time in
which they exercise their trade or calling wear such badge which
shall be supplied by the Commissioner on payment of the fee
appropriate under these Regulations. Such fee shall be over and
above that charged for the licence.
(2) Such badge shall be returned to the Commissioner if the
licence is withdrawn or cancelled or if it ceases otherwise to be
operative. If loss or destruction thereof is alleged, the
Commissioner may require the declarant to confirm his statement
of loss or destruction by means of an affidavit.
Conditions.
law regulating any one or more classes of licences, the
Commissioner may attach to any licence such conditions as he may
deem fit, and in the case of each failure to observe such conditions,
or any of them, the licensee shall be deemed to have acted without
a licence.
Age of licensees.

14. (1) The Commissioner shall not issue any licence to
persons who have not attained the age of eighteen years but he may
grant the renewal of a licence to persons who, on the coming into
operation of these Regulations, are already in possession of the
licence though they have not attained that age.
Cap. 13.
(2) The Commissioner may also grant to persons who, though
they have not attained the age of eighteen years, are authorised
under the provisions of the Commercial Code to exercise trade,
such licences as are connected with the trade exercised by them.

Offences.

15. Any person who fails to comply with or contravenes any of
the provisions contained in regulation 3(2) or in regulations 9 or
11, or who knowingly or recklessly gives false information
required under regulation 6, or who in making an application to the
Commissioner under these Regulations gives information which is
false or misleading in any material particular, shall be guilty of an
offence under these Regulations and shall be liable to the penalties
laid down in the Criminal Code in respect of contraventions.

11. Metal grades (industrial).
12. Petrol vendors.
13. Household goods and furnishing.
14. Launderers and dry cleaners.
15. Stationers and booksellers.
16. Farming and fishing equipment.
17. Toy sellers.
18. Drapery, carpets.
19.  House remover,  burdnara .
20. Any other object not specifically provided for which in the opinion of the
Commissioner of Police should properly be classified under this category.
Category 3  refers to trading licences in respect of -

8. Any other object not specifically provided for, which in the opinion of the
Commissioner of Police, should properly be classified under this category.
Category 4  refers to trading licences in respect of -

3.  Kerosene vendors.
4. Grocers and greengrocers.
5.  Fodder retailers.
6.  Meatsellers.
7.  Bakers and breadsellers.
8.  Wine shop.
9.  Tea and coffee (non-intoxicants) shops.

10.  Any other object not specifically provided for, which in the opinion of the
Commissioner of Police, should properly be classified under this category.
2 For any special extension of the closing time of places of public
entertainment after 1 a.m. on each occasion, a fee of Lm 10.
This fee shall be leviable irrespectively of any fee chargeable for the time
extension in respect of any other licences prevailing on the premises.
Provided that the fee payable for licences in respect of the following trading
categories shall be either as indicated in Table A or as stipulated hereunder,
whichever is the highest:
( a ) real estate agency  ...................................................................  300.00
( b ) local insurance companies (excluding agents of local and
foreign insurance companies, brokers, operators registered as salesmen
under the Insurance Business Act) . .......................................................... 400.00
( c ) an advertising and/or public relations agency  .......................... 250.00

( e ) a wedding hall or any other such place for the purpose of 
holding weddings or other receptions:
