DESIGNATION, COMMAND AND 
ESTABLISHMENT OF THE ARMED FORCES
OF MALTA ORDER

1. The title of this Order is Designation, Command and
Establishment of the Armed Forces of Malta Order.

2.  All forces raised or deemed to have been raised under the
Malta Armed Forces Act, shall be collectively known as the
“Armed Forces of Malta”.
Command.

3.  (1) There shall be a Commander, Armed Forces of Malta,
who shall be appointed by the Minister responsible for defence; and
there may also be appointed by the said Minister, a Deputy
Commander, Armed Forces of Malta, and in the absence or
inability to act of the Commander or Deputy Commander, an
officer to act as Commander, Armed Forces of Malta.
(2) The Commander, Armed Forces of Malta, shall, subject to
the provisions of the Act aforesaid and to any regulations, rules or
orders made thereunder, as well as to the terms and conditions of
his appointment and to any instructions or directives given to him
by the said Minister, have command of the Armed Forces of Malta.
(3) The Deputy Commander shall assist the Commander in the
performance of his functions and duties; and in the absence or
inability to act of the Commander, the Deputy Commander, and in
his absence or inability to act, such other officer as may be
appointed to act as Commander, shall have the same powers of the
Commander.
(4) Notwithstanding the foregoing provisions of this article, the
Minister responsible for defence may place any part of the Armed
Forces of Malta under a separate command and in any such case he
may appoint a separate commander and in respect of such part of
the Armed Forces of Malta, the foregoing provisions of this article
and of article 4 shall apply as if references to the Commander,
Armed Forces of Malta, were references to the commander of the
part of the said forces placed under a separate command.

4.  The establishment of the Armed Forces of Malta and of any
corps, unit or other part thereof, shall be such establishment as the
Minister responsible for defence may, from time to time determine,
and such establishment shall, subject to the Act aforesaid and to
any regulation, rules or orders made thereunder, be governed by the
instructions and orders which the said Minister, or the Commander
or other officer acting under the authority of the said Minister, may

from time to time issue.
