EQUIPMENT AND SYSTEMS REGULATIONS

Title.
Compatible Technical Specifications for the Procurement of Air
Traffic Management Equipment and Systems Regulations.
Interpretation.
Cap. 333.
"Eurocontrol" has the same meaning assigned to it by the
Eurocontrol Act;
"Eurocontrol standard" means the mandatory elements of
Eurocontrol specifications for physical characteristics,
configuration, material, performance, personnel or procedure, the
uniform application of which is recognised as essential for the
implementation of an integrated air traffic services (ATS) system
(the mandatory element shall form part of a Eurocontrol standard
document);
"technical specifications" means the technical requirements
included, in particular, in the tender documents defining the
characteristics of a piece of work, a material, a product or a supply,
and making it possible to describe a piece of work, a material, a
product or a supply objectively in a manner such that it fulfils the
use for which it is intended by the contracting entity. Such
technical prescriptions may include quality, performance, safety
and dimensions, as well as requirements applicable to the material,
product or supply as regards quality assurance, terminology,
symbols, testing and test methods, packaging, marking and
labelling;
"standard" means a technical specification approved by a
recognised standardization body for repeated or continuous
application, compliance with which is not in principle compulsory.

3. The Eurocontrol standards, and subsequent Eurocontrol
amendments, in particular those relating to the areas listed in the
First Schedule, shall be complied with by any person who provides
air traffic management services in Malta.
Mandatory 
elements of 
Eurocontrol 
specifications.
4. The mandatory elements of Eurocontrol specifications
included in the Eurocontrol standards documents specified in the
Second Schedule shall be adopted inasmuch as they are necessary
for the implementation of an integrated European air-traffic-
management system.
