PRESERVATION OF FERTILE SOIL REGULATIONS

2. (1) In these regulations, "the Act" means the Fertile Soil
(Preservation) Act.
(2) Words and phrases used in these regulations shall have the
same meaning as is assigned to them in the Act.
Application for 
transportation of 
fertile soil.
3. (1) Where any person desires to transport more than one
half cubic metre of fertile soil, he shall apply therefor in writing to
the Director and shall state in his application -
( a ) the site from which he intends to remove such soil;
( b ) whether he intends to erect any building on the said
site and, if not, the reason for the removal of such soil;
( c ) on which site he intends to deposit such soil, and
whether such site is owned by him or whether it is
leased to him;
( d ) the approximate volume of fertile soil he intends
removing;
( e ) the name and address of the contractor engaged for the
transportation of such soil;
( f ) the registration number of the trucks to be used for the
transportation of such soil;
( g ) the manner in which such soil is intended to be
deposited; and
( h ) any other information which the Director may, from
time to time, require.
(2) Every such application should reach the Director at least
fifteen working days before the removal of fertile soil is intended to
take place.
(3) An application made under subregulation (1) shall be
deemed to be the notice required under article 4 of the Act provided
it is made on the form supplied by the Director and complies in
every respect with the requirements of article 5(1) of the Act.
Deposit of fertile 
soil.
4. Except with the permission of the Director, no person shall
deposit any fertile soil on any land already covered with not less
than three feet of fertile soil, or in heaps, or in any other manner
which would render it unsuitable for immediate cropping.
