FORT CHAMBRAY (DESIGNATED SPECIAL 
AREA) ORDER

2. Fort Chambray in the limits of G _hajnsielem in the Island of
Gozo, shown outlined in red in a plan marked as Document X
enrolled in the records of Notary Public in the Lands Department
Dr. Vincent Miceli by Deed No. 121 dated 13th April, 1993
(hereinafter referred to as the Special Area) is hereby designted as a
Designated Special Area for the purposes of the Immovable
Property (Designation of Special Areas) Regulations.
Non-resident

this Order applies.

3. (1) This Order shall apply to non-resident persons falling
under the definition in paragraph ( a ) of the definition of "non-
resident person" in article 2 of the Immovable Property
(Acquisition by Non-Residents) Act (hereinafter referred to as "the
Act") and to non-resident persons falling under paragraph ( b ) of the
said definition but only where none of the shares or interests in
such body of persons are issued or transferable by delivery to
bearer:

Provided that the interest or shares in any such entity may
be held and registered in the name of a nominee, resident in Malta,
provided such nominee obtains permission inder such conditions as
the Minister may deem appropriate to issue in accordance with
article 17(2) of the Exchange Control Act.

(2) Where the non-resident person is a body of persons as
defined in subregulation (1), it shall be a condition of the permit
that the shares or interests in the said body of persons shall not be
transferable to any person  inter   vivos  without the permit in writing
by the Minister and where the shares or interests are held by a
nominee, a new permission under the Exchange Control Act shall
be obtained prior to the transfer of any share or interest in the body
of persons to new beneficial interests and such a change in
beneficial interests shall be deemed to be a transfer of the
registered shares or interests for the purpose of the Duty on
Documents and Transfers Act.
(3) For the purposes of a permit as is referred to in
subregulation (2), an application shall be made on behalf of the
person to whom such transfer is intended to be made, giving such
details or other documentation relative to such person as apply in
respect of the original shareholders as prescribed under this Order.
Such permit shall only be granted upon the payment of the fee
referred to in article 7.

Immovable

4. (1) This Order applies to the immovable property marked
on the plan referred to in article 2.
(2) Each residential unit or the Hotel being part of the
designated property may be acquired or transferred under any title
but may not be acquired, transferred or held under any timeshare
scheme or other similar system of multi-property.
Application. 5. (1) An application for the acquisition by a non-resident
person of any immovable property in the special area or for the
transfer of shares in a body of persons holding such property, shall
be made in the form as shown in the First Schedule, and shall
contain such particulars and be accompanied by such documents as
are prescribed in the said form.
(2) Applications may be made in relation to more than one unit
of immovable property in the special area, but a separate fee as
prescribed in article 3(3) shall be payable in respect of each single
unit.
Permissible uses. 6. (1) The immovable property to which this Order applies
may, subject to the provisions of this article, be put to any use
permissible by law.
(2) The provisions of subregulation (1) shall not be considered
as exempting from the provision of any law requiring any permit
for a change in land use, for the exercise of any trade or profession,
or generally to make any particular use of the immovable property.

(3) Notwithstanding the other provisions of this article where
the immovable property is put to residential use (whether such use
is long term or temporary) it may only be used by the owner, his
friends or family, and where the owner is a body of persons by the
shareholders, directors or employees of the company, and may only
be leased for residence therein by third parties through the services
of Fort Chambray Management Limited which is hereby being
designated as the letting company for the purposes of regulation
5( b ) of the Immovable Property (Designation of Special Areas)
Regulations.

(4) The person to whom a permit is issued to acquire
immovable property to which this Order applies shall enter into an
agreement with Fort Chambray Management Limited, providing for
the matters set out in the Second Schedule, and the said company is
hereby being designated as the management company for the
purposes of regulation 5( a ) of the Immovable Property
(Designation of Special Areas) Regulations.
(5) The Minister may by another Order designate other
companies as letting and or management companies instead of or in
addition to the companies designated under subarticles (3) and (4),
and leasing through a company so designated and an agreement
with a company so designated shall be deemed to be leasing
through the company referred to in subregulation (3) and an
agreement with the company referred to in subregulation (4)
respectively.
(6) Any restriction as to the use of any part of the designated
area in the deed in the records of the Notary Public in the Lands

Department Dr. Vincent Miceli by Deed No. 121 dated 13th April,
1993 shall be deemed to be also imposed by this Order and shall
apply independently of any change in the conditions laid down in
the said deed that may be made by the interested parties.

SECOND SCHEDULE
(Article 6)
The following matters must be stated in any management contract entered
into between the management company specified in article 6 and the purchaser of
any residential unit.
1. The management fee, its method of computation and when any part of the
fee includes any fixed fees the rules regulating any increases to such fees.
2. The services, being offered by the management company for the
management fee which shall include:
( a ) the maintenance of the exterior of the residential unit;
( b ) the maintenance and unkeep of roads and common areas, electricity,
water and telephone utilities and access to the unit;
( c ) security arrangements;
( d ) refuse collection or disposal arrangements;
( e ) television receiving facilities up to the unit not including rental and, or
use where applicable.
3. The right of access of any owner of a residential unit or a representative of
any Owner’s Association, if such is in existence, to the accounts of expenditure and
other costs forming the basis of the management fee and such other conditions
applicable to such right of access.
4. Any prohibitions applicable to the owner or users of the property.
5. The method of amendment of the terms of the management contract and
whether such amendments may, apply retrospectively or not.
6. The term of the contract, the rights of termination and any applicable
penalties and, if applicable, the date of review of the conditions of the contract.
7. The method of dispute resolution, if any.
8. Any other mandatory rules which will he binding on any future purchaser of
any residential unit, other than those conditions specified in the public deed dated
13th April, 1993 whereby Forty Chambray Limited acquired Fort Chambray or any
subsequent public deed applicable to the specific unit or any other applicable law or
regulation.
