OVERSEAS POST REGULATIONS

Title.
Interpretation.
Cap. 254.
"aerogramme" means an air mail postal article consisting of a
letter written on a special air letter form provided or approved by
the Postmaster General;
"air mail postal article" means a postal article intended by the
sender to be transmitted to destination by an air mail service;
"air mail service" means a service established by or under the
direction of the Postmaster General for transmission of mails by
air;
"articles for the use of the blind" has the same meaning as is
assigned to it by regulation 35;
"coin" means coin (whether or not current), except such as is
used or designed for purposes of ornament;
"incoming" applied to a postal article of any description means a
postal article received through the post from a place outside Malta
at a Post Office in Malta;
"insured letter" and "insured box" mean respectively any insured
letter and insured box which is transmissible under the provisions
of the Universal Postal Union Convention, and of the Detailed
Regulations made thereunder, for the exchange of insured letters
and boxes;
"outgoing" applied to a postal article of any description means a
postal article posted in Malta for onward transmission through the
post to a place outside Malta;
"parcel" means a postal article which is posted in Malta as a
parcel in terms of the Act or under these or any regulations made
under the Act, or which is received in Malta from abroad by parcel
post;
"postal form" means a form issued by or under the authority of
the Postmaster General;
"paper money" includes:
( a ) bank notes or currency notes, being current in Malta or
elsewhere;
( b ) money orders and postal orders;

( c ) unobliterated postage stamps available for current use
in Malta or elsewhere;
( d ) treasury bills, bills of exchange, promissory notes,
cheques, credit notes which entitle the holder to money
or goods, and all orders and authorities for the
payment of money, whether negotiable or not;
( e ) bonds and coupons relating thereto, and other
securities for money, whether negotiable or not; and
( f ) coupons, vouchers, tokens, cards, stamps or similar
documents, exchangeable (singly or with other such
documents) for money, goods or service;
"prescribed" means prescribed by these regulations;
"printed papers" has the same meaning as is assigned to it by
regulation 27;
"small packet" has the same meaning as is assigned to it by
regulation 33.
Application. 3. These regulations, except as otherwise provided, apply
only to postal articles and parcels posted in Malta for delivery to
any place outside Malta or posted in any place outside Malta for
delivery to any place in Malta.
Hours of business. 4. The hours of business at the General Post Office, the Parcel
Post Office, Branch Post Offices and the Central Mail Room shall
be specified in the Fourteenth Schedule.
Rates of Postage. 5. There shall be charged and paid the following rates of
postage, charges and fees on the articles specified hereunder:
(1) Upon outgoing postal articles specified in the First and
Second Schedules, the rates of postage as indicated
therein;
(2) Upon the supply of postage stamps and postal
stationery, the fees and charges indicated in the Sixth
Schedule.
LETTER POST
Letter post. 6. For the purpose of regulations 7 to 56, both inclusive, a
postal article shall, unless otherwise specified, mean and include
any postal article other than a parcel.
Method of address. 7. (1) Every outgoing postal article shall be legibly
addressed, and the address, whether handwritten or printed, shall
run parallel to the length of the envelope or card, leaving enough
space above the address for the postage stamps and postmarks.
(2) Telegraphic addresses are not acceptable.
(3) Nothing shall be written, printed or placed on the address
side of an outgoing postal article which is likely to impede its
processing by officers of the Post Office.
Affixing of postage 
stamps.
8. Postage stamps or franking machine impressions denoting
pre-payment of postage rates and postal fees shall be affixed, or
printed, as the case may be, on the upper right hand corner of the
address side of the postal article.

Used envelopes not 
acceptable for 
transmission by 
post.
9. An outgoing postal article shall not be accepted for
transmission by post if it is enclosed in an envelope, wrapper or
cover bearing cancelled postage stamps, or postmarks or other
evidence of previous transmission through the post, except where
such postal article has been redirected as provided under the Act or
regulations made thereunder (including these regulations) or under
the appropriate regulations of any foreign Postal Administration.
Certain cards to be 
enclosed.
10. Cards of the varieties known as "tinselled" and "beaded"
and cards with "pearling" decorations, shall not be accepted for
transmission by post unless enclosed in envelopes.
Panel (window) 
envelopes.
11. Envelopes with a transparent panel may be used provided
that -
( a ) the panel extends parallel to the length of the
envelope;
( b ) the panel is located not less than 40mm from the top
edge of the envelope and not less than 15mm from the
left and right-hand and bottom edges of the envelope;
( c ) the panel is not bordered by a coloured band or frame;
( d ) no writing or printing other than the address may be
displayed through the panel, and the address must
appear through the panel in such manner as to be
easily read; and
( e ) the enclosures are so folded that they cannot move
about in the envelope thereby causing the address to be
hidden.
Transparent 
envelopes.
12. Outgoing postal articles (except printed papers) in
envelopes which are wholly transparent (even if an address label is
affixed thereon) and envelopes which have an open panel or more
than one panel are not acceptable for transmission by post.
Prohibitions.
order to be transmitted by post, or delivered by post:
( a ) any postal article containing any explosive,
inflammable, dangerous, dirty, noxious or deleterious
substance; or
( b ) any postal article containing any sharp instrument or
any such other article or thing which might expose to
injury any person or which might soil or damage any
other postal article in the course of transmission by
post; or
( c ) any postal article which is seditious within the
meaning of any enactment relating to sedition; or
( d ) any postal article of any kind or form whatsoever
which is in any way threatening, offensive or libellous;
or

( e ) any postal article of any kind or form whatsoever
which is pornographic or obscene in accordance with
regulations made under section 208 of the Criminal
Code; or

( f ) any postal article containing any living creature other
than a creature accepted by the Postmaster General as
transmissible by post; or
( g ) any postal article containing any proposal, circular or
ticket relating to lotteries other than lotteries set up or
permitted by the Government of Malta; or

( h ) any postal article containing any imitation of a
currency note or of a bank note or any of the forged
instruments referred to in sections 166 and 167 of the
Criminal Code; or
( i ) any postal article containing or bearing any fictitious
stamp (not being a fictitious stamp which is authorised
to be made by or under Post Office regulations or by or
under the appropriate regulations of any foreign Postal
Administration) or any counterfeit impression of a
stamping or franking machine used under the direction
or with the permission of the PostmasterGeneral or any
counterfeit of any other impression authorised by these
regulations for use to denote payment of postage or
fees; or
( j ) any postal article having thereon, or on the cover
thereof, any words, letters or marks which are used
without due authority but which signify or imply, or
may reasonably lead the recipient to believe that the
postal article is sent on Government Service; or
( k ) any postal article of such size, form or colour or so
made up for transmission by post as to be likely, in the
opinion of the Postmaster General, to embarrass the
officers of the Post Office in dealing with the postal
article; or
( l ) any postal article having anything written, printed or
impressed upon or attached thereto which, either by
tending to prevent the easy and quick reading of the
address on the postal article or by inconvenient
proximity to the stamp or stamps used in the payment
of postage, or in any other way, is in itself, or in the
manner in which it is written, printed, impressed or
attached, likely, in the opinion of the Postmaster
General, to embarrass the officers of the Post Office in
dealing with the postal article; or
( m ) any postal article whereon the payment of postage or
fees purports to be denoted by any stamp or impression
which has been previously used to denote payment of
the postage or fees on any other postal article; or
( n ) any postal article bearing more than one address on the
address side of the article; or
( o ) any postal article containing any narcotic or
psychotropic substance or any other drug or medicine
unless its transmission by post is authorised by or
under any enactment or regulation; or
( p ) any postal article containing any item the importation

or circulation of which is prohibited in the country or
place of destination or in any country or place through
which the said postal article will be transmitted.
(2) Notwithstanding the provisions of subregulation (1)( g )
relating to lotteries set up or permitted by the Government, the
Postmaster General may refuse to transmit any postal article
relating to any such lottery as aforesaid if such article does not
conform with instructions relating thereto issued by a competent
authority and communicated to the Postmaster General; and in any
such case he may return it to the sender or otherwise deal with it as
he may deem fit.
(3) For the purposes of this regulation, "lottery" includes any
scheme for distributing prizes under which the recipients or the
number or the value of the prizes depend on a future uncertain
event or a combination of such events.
Postal articles for 
different persons.
14. (1) There shall not be posted, or tendered or made over in
order to be transmitted by post, or delivered by post any outgoing
postal article consisting of, or containing, two or more postal
articles directed to different persons with different addresses except
upon payment as provided in this regulation.
(2) When any such postal article is posted, or tendered, or
made over in order to be transmitted by post, all postal articles
contained therein shall be transmissible by post upon pre-payment
of the relative postage in respect of each separate postal article and
if the postage is not so pre-paid the postal article shall be dealt with
as unpaid or insufficiently pre-paid.
Postal articles 
containing 
different items.
15. Where an outgoing postal article consists of, or contains,
two or more articles which would separately be transmitted at
different rates of postage, the postal article is transmissible at the
highest of such rates, and if the postage is not pre-paid at that
highest rate the postal article shall be dealt with as an insufficiently
pre-paid postal article.
Closed 
correspondence.
16. An outgoing postal article having the character of actual or
personal correspondence or bearing or containing anything of such
character, or which is closed against inspection, shall not be
transmissible otherwise than as a letter; and any such postal article
bearing postage less than that required for a letter shall be treated
as an insufficiently pre-paid postal article.
Packing and 
posting.
17. (1) Every outgoing postal article shall be made up and
secured in such a manner as in the opinion of the Postmaster
General is calculated to prevent damage to any other postal article
or parcel in the course of transmission or to any receptacle in which
the same is conveyed, or injury to an officer of the Post Office or to
any other person who may deal with such postal article. In the
event of such damage or injury the sender shall be liable to pay the
Postmaster General such reasonable compensation as the latter
shall determine.
(2) When an outgoing postal article is posted or tendered or
made over in order to be transmitted by post, the sender shall fill up
such certificates and documents and affix such labels relating to the
contents of the postal article as may be required by the law of the

country or place to which it is addressed, or otherwise as the
Postmaster General may direct.
Size and weight. 18. Save as the Postmaster General may either generally or in
any particular case allow, no outgoing postal article shall be posted
or transmitted by post unless it conforms in all respects to the limits
of size and weight specified in the Seventh Schedule:
Provided that any incoming postal article which does not
conform to the limits of size and weight specified in the Seventh
Schedule may also be delivered.
Pre-payment of 
postage and fees.
19. (1) Save as otherwise provided in these regulations, or as
the Postmaster General may direct, the postage and fees payable on
every outgoing postal article and the fees payable in respect of
postal facilities shall be pre-paid.
(2) The provisions of subregulation (1) shall not apply, or shall
apply with such necessary modifications, to postage and fees
payable on outgoing postal articles in respect of which the
Postmaster General has entered into any arrangement with a foreign
Postal Administration regarding such pre-payment of postage and
fees.
Method of 
pre-payment
20. The pre-payment of postage or fees due under these
regulations on outgoing postal articles shall be denoted:
( a ) by adhesive postage stamps; or
( b ) by impressions of franking machines operated under
the control and direction, or with the permission, of
the Postmaster General; or
( c ) by the use of a stamped envelope, cover, card or other
postal form, issued by the Postmaster General; or
( d ) by the use of printed postage stamps cut out of or
otherwise detached from an envelope, postcard,
wrapper, letter or other postal form, issued by the
Postmaster General; or
( e ) in such other manner as the Postmaster General may
from time to time permit.
Unpaid or 
underpaid postage.
21. (1) All outgoing postal articles, other than registered
postal articles, upon which no part, or a part only, of the postage
payable thereon has been pre-paid, shall be dealt with as follows:
( a ) where the address of the sender is shown on the outer
cover, the postal article shall be returned to sender
appropriately endorsed for the payment of the
deficient postage;
( b ) (i) where an outgoing airmail postal article cannot
be returned to the sender for the full payment of
postage, it shall be charged with double the
amount of the deficient postage and forwarded
to destination if the amount of pre-paid postage
is equal to, or is more than, 75% of the postage
required for its transmission by air;
(ii) where the pre-paid postage of an outgoing
airmail postal article which cannot be returned

to sender is less than 75% of the postage
required for its transmission by air, it shall be
forwarded by surface mail; provided that if such
postal article is pre-paid at less than the postage
required for its transmission by surface mail, it
shall be charged double the deficient postage
required for its transmission by surface mail;
and
( c ) an insufficiently pre-paid outgoing postal article
intended for transmission by surface mail and which
cannot be returned to sender shall be charged with
double the deficient postage.
(2) An incoming postal article, including a registered postal
article, upon which no part, or a part only, of the postage payable
thereon has been paid, shall be delivered to the addressee and
charged with such amount as the foreign Postal Administration
concerned shall have requested to be collected.
(3) Any amount charged under subregulation (1)( a ) and under
subregulation (2) shall be paid by the sender or the addressee, as
the case may be, and the Postmaster General may withhold
transmission or delivery until such amount is paid.
Irregular postal 
articles.
22. Save as otherwise provided in these regulations, any postal
article in the post which is found not to comply with the provisions
of the law of the country or place in which the postal article was
posted or to which it is addressed or of any country through which
it may pass, or which is not accompanied by any document required
by such provisions, as aforesaid, may be disposed of in such
manner as the Postmaster General may deem appropriate.
Ownership of 
postal articles.
23. Save as otherwise provided in the Act or in these
regulations, a postal article shall remain the property of the sender
until it is delivered to the rightful owner, except when the said
article has been seized in pursuance of the legislation of the country
of destination.
Undelivered postal 
articles.
24. An incoming postal article which, in the opinion of the
Postmaster General, cannot for a valid reason be delivered to the
addressee or which has been refused by the addressee or which has
been duly delivered but is returned unopened to the Post Office
with an indication that the addressee has refused delivery or which
cannot be delivered by reason of any provision of the Act or of
these regulations, shall be treated as an undeliverable postal article
and shall be dealt with as provided in these regulations.
Disposal of 
undeliverable 
postal articles.
25. (1) An incoming postal article which is undeliverable
shall be returned by surface mail to the country of origin, with the
reason for non-delivery clearly indicated on such postal article: 
Provided that unregistered postcards without the
particulars of the sender shall be disposed of in such manner as the
Postmaster General may deem appropriate:
Provided further that an unregistered postal article
containing printed papers shall be disposed of as the Postmaster
General may deem appropriate, unless the sender has requested, by

means of a note written on the outside of such article, the return
thereof in case of non-delivery.
(2) A postal article posted in Malta for delivery at a place
outside Malta which is returned to Malta as undeliverable, shall be
dealt with as follows:
( a ) an undeliverable postal article which bears a legible
return address on the outside shall be returned
unopened and appropriately endorsed to that address;
( b ) an undeliverable postal article which does not bear a
legible return address on the outside shall be opened
by the Postmaster General and if the address of the
sender can be ascertained, it shall then be returned to
him under official cover:
Provided that if such postal article is found to
contain paper money, coins or any other valuables, it
shall be compulsorily registered at the expense of the
sender before being so returned, and if the sender
refuses to pay the postal charges due on that postal
article the Postmaster General shall dispose of it as he
may think fit without prejudice to his right to claim
from the sender those postal charges;
( c ) an undeliverable postal article, which has no
indication of the sender and which in the opinion of
the Postmaster General contains items of value or
importance, shall be recorded in the appropriate
register and shall, unless claimed, be kept at the Post
Office for a period not exceeding one year from the
day on which the postal article is so recorded, and
thereafter be disposed of in such manner as the
Postmaster General may deem fit.
POSTCARDS
Postcards. 26. (1) Postcards shall comply with the limits of size and
weight as specified in the Seventh Schedule.
(2) No writing or printing, except the address and any postal
directions recognised by the Convention of the Universal Postal
Union, shall appear on the right-hand half of the address side of a
postcard.
(3) On the left-hand half of the address side of a postcard only
messages and conventional formulas of courtesy expressed in not
more than five words or five initials are allowed.
(4) Outgoing postcards which do not comply with any or all of
the conditions specified in the foregoing subregulations shall be
transmitted at letter rates, and if posted and pre-paid at postcard
rates, shall be deemed to be insufficiently pre-paid.
(5) Postcards shall not be eligible for registration. 
PRINTED MATTER
Printed papers.

27. (1) Printed papers mean impressions or copies produced
on paper, parchment, card or similar material, by means of
letterpress printing, engraving, lithography, photography, or any

other readily recognisable mechanical process ordinarily used to
produce a number of identical copies, and includes printed
circulars, notices produced in imitation of typewritten original by
any of the said mechanical processes but not copies produced by
typewriter (top or carbon copies), tracings or hand-stamps.
(2) Any outgoing printed paper whose text has been modified
after printing or which bears any marks capable of constituting a
correspondence shall be deemed to be a letter and shall be
transmissible at letter rates:
Provided that manuscripts or typescripts, with or without
corrections, intended for publication shall be deemed to be printed
papers:
Provided further that cards including greeting cards and
invitation cards, but excluding postcards, shall be deemed to be
printed papers even if they contain any marks capable of
constituting a correspondence.
(3) Save as the Postmaster General may either generally or in
any particular case allow, no outgoing postal article consisting of
printed paper shall be posted, transmitted or delivered by post
unless it conforms in all respects to the limits of size and weight
specified in the Seventh Schedule.
(4) Every outgoing postal article consisting of printed paper
shall be prominently marked "Printed Matter" and shall be subject
to examination in the post, and if posted without a cover shall not
be fastened or otherwise treated so as to prevent easy examination.
A covered printed paper shall be unfastened or, save as the
Postmaster General may either generally or in any particular case
allow, so packed that the contents can be easily examined without
breaking any seal or tearing any paper or cutting any string or
separating any adhering surfaces.
(5) Outgoing printed papers may be posted, transmitted or
delivered by post under sealed, transparent or opaque cover subject
to the following conditions:
( a ) the Postmaster General may request the sender or the
addressee to open the items or some of the items so
packed for verification of contents;
( b ) the address of the addressee, of the sender, and the
postage-paid imprint, if placed under the transparent
or opaque cover, shall be so placed as to be easily
legible through the said cover; the wrapping shall
include, on the address side, a sufficiently wide part on
which service instructions, any reasons for non-
delivery or, when applicable, the addressee's new
address, can be written by hand, or shown by means of
a label or by any other process as on paper and a
sufficiently wide part of the wrapping on the address
side must have the properties of paper.
(6) Outgoing printed papers wrapped in plastic may also be
pre-paid by means of franking machine impressions made on a
self-adhesive label, or in some indelible way, on the actual

wrapping.
(7) No outgoing printed paper shall contain or bear any
communication in the nature of a letter even though such
communication does not fall within the definition of a letter or is
otherwise allowed by these regulations.
(8) No paper money shall be posted, transmitted or delivered
by post as printed paper or in a postal article consisting of printed
paper.
(9) The Postmaster General may delay the despatch or delivery
of printed papers whenever he deems it necessary to do so in order
to secure the due despatch or delivery of letter mails.
(10) Printed papers which do not conform to any or all of the
conditions and limitations specified in the foregoing paragraphs of
this regulation shall be transmitted at letter rates, and if posted and
pre-paid at the printed paper rates, shall be deemed to be
insufficiently pre-paid.
(11) When the number of postal articles consisting of printed
papers posted at any one time exceeds the amount of ten thousand
(10,000), the Postmaster General may authorise that such postal
articles be transmitted at a discounted rate of postage of 20% of the
Printed Matter rate:
Provided that the foregoing provision shall only apply if
such postal articles are presented for posting in a presorted state
according to the countries of destination:
Provided further that the Postmaster General may grant
discounts up to a maximum of 20% of the postage rate of other
categories of mail if postings in excess of ten thousand (10,000) are
made at any one time and the postal articles are presented for
posting in a presorted state according to the countries of
destination.
(12) The Postmaster General may recommend to the Minister
other rebates of postage to all categories of mail if such categories
are also posted at any one time in excess of one hundred thousand
(100,000) and presorted according to the countries of destination.
Newspapers. 28. Subject to the provisions of these regulations, newspapers
are transmissible at the specially reduced rate of postage when they
consist of publications falling within the definition of newspaper,
are registered with the Press Registrar and with the Post Office, and
are prominently marked "Newspaper Post".
Definition of 
newspaper and 
periodical.
29. For the purpose of these regulations, a newspaper means a
publication that is printed and published in Malta and consisting
wholly or in part of political or other news or of articles relating
thereto or to other current topics, with or without advertisements
and whether printed for sale or for gratuitous distribution; and
includes a periodical that is printed and published in Malta for the
dissemination of information of public interest or that is devoted to
literature, the sciences, arts, religion, and to technical or practical
subjects.

Registration of 
newspapers with 
Post Office.
30. (1) Subject to the provisions of this regulation, a
newspaper shall, upon payment of the registration fee specified in
the Sixth Schedule, be registered with the Post Office.
(2) To qualify for registration with the Post Office, a
newspaper shall -
( a ) be published in parts or numbers at regular intervals of
not more than three months, every part or number
being deemed to be a separate newspaper;
( b ) have the full title and date of publication printed at the
top of the first page, have each page consecutively
numbered, and the whole or part of the title and the
date of publication at the top of every subsequent
page;
( c ) consist of printed paper sheets without board, cloth,
leather or other substantial binding; and 
( d ) be of Maltese origin.
(3) The Postmaster General shall decide whether a publication
is eligible for registration with the Post Office in accordance with
the provisions of this regulation and his decision shall be final.
(4) A newspaper which, after registration with the Post Office,
shall cease to be registered with the Press Registrar or shall cease
to be a newspaper within the meaning of regulation 27, or shall fail
or cease to comply with or satisfy the provisions of subregulations
(1) and (2), shall cease to be so registered with the Post Office.
Conditions of 
posting of 
newspaper.
31. (1) Every registered newspaper shall be subject to
examination in the post; and if posted without a cover shall not be
fastened or otherwise treated so as to prevent easy examination.
The cover or envelope of a covered registered newspaper shall be
unfastened or (save as the Postmaster General may either generally
or in any particular case allow) so adapted that the contents can be
easily examined without breaking any seal or tearing any paper or
cutting any string or separating any surfaces.
(2) Save as the Postmaster General may either generally or in
any particular case allow, every registered newspaper posted in an
envelope or cover shall be so folded and covered as to permit the
title and date of issue to be easily inspected.
(3) No article which is not part of the newspaper shall be
posted in, or in the cover or envelope with, the newspaper.
Supplement to 
newspaper.
32. (1) A publication shall be deemed to be a supplement to a
newspaper and to be part thereof and transmissible by post at the
newspaper rate of postage if:
( a ) it is printed on paper and consists wholly or mainly of
reading matter like that of the newspaper or wholly or
partly of pictorial matter illustrative of articles in the
newspaper or partly of advertisements;
( b ) it is enclosed with the newspaper to which it is a
supplement; and
( c ) the heading "Supplement" and the date and title of the

newspaper to which it is a supplement are printed at
the top of every page.
(2) A supplement to a newspaper shall not exceed in size or
weight the newspaper to which it is a supplement.
(3) A publication designed primarily for advertising purposes
shall not be deemed to be a supplement to a newspaper within the
meaning of this regulation and if posted with the newspaper shall
not be transmitted at newspaper rate.
SMALL PACKETS
Small packets. 33. (1) The expression "small packet" in these regulations
means a postal article which consists of or contains goods or
articles, including trade samples, and which contains and bears
nothing else except an open invoice reduced to its essential
elements, any customs declaration which may be required, and the
name and address of the sender and of the addressee.
(2) Small packets shall bear on the address side in the top
left-hand corner the words "Small Packet" or its equivalent in a
language known in the country of destination.
(3) The provisions of regulation 27(4) in so far as they refer to
the packing of outgoing printed papers shall apply  mutatis
mutandis  to small packets.
(4) Outgoing small packets which do not conform to any or all
of the conditions and limitations specified in the foregoing
subregulation shall be transmitted at letter rates and, if posted and
pre-paid at small packet rates, shall be deemed to be insufficiently
pre-paid.
ARTICLES FOR THE USE OF THE BLIND
Articles for the use 
of the blind.
34. (1) No postage shall be payable on outgoing postal articles
consisting of articles for the use of the blind provided that -
( a ) the postal articles are sent by or addressed to a blind
person or an institution or organisation that is
recognized by the Postmaster General as an institution
or organisation which serves the blind;
( b ) every postal article is marked on its outside "Articles
for the Blind" and bears the name and address of the
sender;
( c ) every postal article is posted either without a cover or
in a cover which can be easily removed for the purpose
of examination;
( d ) no postal article contains any article not being an
article for the use of the blind;
( e ) no postal article contains any communication or
inscription either in writing or printing other than
instructions for the use of any enclosed article; and
( f ) the postal article complies with the limits of size and
weight as specified in the Seventh Schedule.
(2) For the purpose of this regulation a postal article shall

include a parcel containing solely articles for the use of the blind.
Definition of 
articles for the use 
of the blind.
35. In these regulations, the expression "articles for the use of
the blind" means -
( a ) books and papers (including letters to and from blind
persons) impressed or otherwise prepared for the use
of the blind;
( b ) papers posted to any person for the purpose of being so
impressed or prepared;
( c ) aids for the teaching of Braille to the blind;
( d ) plates for embossing literature for the blind;
( e ) any form of special recording for the use of the blind;
and
( f ) Braille instructional devices, including tools, precision
instruments and games (including card games), and
includes any other article which the Postmaster
General considers to be an article for the use of the
blind.
AIR MAIL LABELS AND AEROGRAMMES
Air Mail label.

with such other words as may indicate the intention of the sender
that the postal articles i be transmitted by an air mail service.
Aerogrammes.
not contain any enclosure; and any outgoing postal article
resembling an aerogramme found in the post which does not
comply with the definition of an aerogramme or which is found to
contain any enclosure shall be treated as an insufficiently pre-paid
postal article.
POSTAL FACILITIES
General.
the charges specified in the Sixth Schedule and the said facilities
shall be subject to the conditions and provisions contained in these
regulations.
(2) The postal facilities referred to in the Sixth Schedule shall
be provided by the Postmaster General at such times, during such
periods and at such post offices, in such circumstances, or on such
conditions (not being inconsistent with the provisions of these
regulations) as the Postmaster General may from time to time
consider expedient.
Express delivery 
service.
39. (1) Outgoing postal articles intended for delivery in a
country whose Postal Administration operates an express delivery
service may bear an Express Delivery label or be conspicuously
marked with the words "Express Delivery" or with such other
words indicating the intention of the sender that the postal articles
be delivered by express delivery after their arrival at the
appropriate delivery office.
(2) Incoming postal articles bearing an Express Delivery label
or conspicuously marked with the words "Express Delivery" or

with such other words indicating the intention of the sender that the
postal articles be delivered by express delivery, shall be delivered
by special messenger as soon as possible after their arrival in
Malta.
Express delivery 
fee.
40. Upon every outgoing postal article marked "Express" there
shall be charged and pre-paid in addition to the postage the fee
specified in the Sixth Schedule.
Certificate of 
posting.
41. Any person who wishes to have a record that an
unregistered postal article has been posted to a particular address
shall hand in the postal article at a Post Office and a certificate of
posting shall be issued. The charge for this certificate, as specified
in the Sixth Schedule, shall be payable by means of postage stamps
affixed on the certificate.
Withdrawal from 
the post by sender.
42. (1) The sender of an outgoing postal article may have it
withdrawn from the post, or have its address altered so long as the
postal article has not been delivered to the addressee, or has not
been confiscated or destroyed by the competent authorities of the
countries through which it has been transmitted or of the country of
destination, and provided that the Postmaster General considers
that the reasons for withdrawal or alteration of address are
satisfactory.
(2) When an outgoing postal article in respect of which a
request for withdrawal or alteration of address has been made by
the sender is still in the possession of the Malta Post Office, the
sender shall, at the time of making the request, pay the search fee as
specified in the Sixth Schedule.
(3) A request for withdrawal or alteration of address on an
outgoing postal article which has left the Malta Post Office shall be
forwarded by post, or, if the sender so requests, it shall be
forwarded by any other expeditious means at the expense of the
sender; the expense of forwarding the request other than by post
shall be paid by the sender together with the search fee specified in
the preceding subregulation.
(4) Fees and expenses paid in accordance with the preceding
subregulation shall not be refunded to the sender if the postal
article is not found or if it is subsequently not withdrawn.
(5) The postage and any registration fee paid on an outgoing
postal article which is withdrawn shall not be refunded; but if the
stamps affixed to any such postal article have not been cancelled by
an official post-mark at the time it is found, the postal article shall
be returned to the sender with the stamps uncancelled.
Enquiries and 
compensation.
43. Enquiries concerning an alleged non-delivery, damage or
loss of a postal article, whether registered or not, shall be made on
the form prescribed in the Twelfth Schedule subject to the
following conditions:
( a ) the enquiry must be made before the lapse of twelve
months from the date of posting, and must be
accompanied by a fee as specified in the Sixth
Schedule, which fee shall be payable in postage
stamps affixed to the said prescribed form;

( b ) no compensation is payable on unregistered postal
articles other than parcels;
( c ) in the case of registered postal articles, the enquiry
must be accompanied by the official registration
receipt issued at the time of posting. 
Damage/loss 
certificate.
44. The addressee of a postal article may request the issue of a
certificate when it is established that the postal article has been
damaged, lost or destroyed while in course of transmission through
the post; such certificate is issued on payment of a fee as prescribed
in the Sixth Schedule.
REGISTRATION
Registration.
outgoing postal article, except a parcel, may be registered.
(2) An outgoing postal article intended for transmission by
registered post shall be handed for registration to an officer at a
Post Office and an official receipt obtained therefor.
(3) The fee, as specified in the Sixth Schedule, chargeable for
the registration of an outgoing postal article shall be pre-paid in
postage stamps affixed to the postal article or by means of franking
machine impressions.
Method of address.
outgoing postal article is directed shall be printed or written fully
and correctly on the cover and shall not be written in pencil other
than a copying-ink pencil.
Receipt of 
registered postal 
articles.
47. On the delivery of an incoming registered postal article the
addressee, his representative, or a member of the household shall,
unless instructions to the contrary are given to the Postmaster
General by the addressee, give a written receipt therefor on the
appropriate form; and when such a receipt is not obtained the postal
article shall be considered as undeliverable.
Packing.
by registered post shall be made up in a reasonably strong cover
appropriate to its contents and the contents shall be adequately
packed to prevent damage in the course of transmission.
(2) Adhesive tape bearing in print the name of the sender may
be used for sealing items submitted for registration, and if
transparent adhesive tape is used to seal such items, at least two
signatures of the sender shall be applied under the tape or tapes.
(3) Outgoing postal articles sealed with coloured adhesive tape
shall not be eligible for registration.
(4) Except as the Postmaster General may either generally or
in any particular case allow, outgoing postal articles having affixed
thereon address labels shall not be eligible for registration.
Advice of delivery.
the time of posting arrange for the advice of its delivery to be sent
to him upon payment of the fee specified in the Sixth Schedule,
which fee shall be pre-paid in postage stamps affixed to the Advice
of Delivery Card:

Provided that any enquiry, made within twelve months
from the date of posting, regarding the disposal of such an item
shall be exempted from the enquiry fee as specified in the Sixth
Schedule.
Compensation. 50. Subject to the provisions of these regulations:
( a ) if any article of value enclosed in or forming part of
the contents of a registered outgoing postal article is,
while in the course of transmission through the post,
lost or damaged so as to partly or entirely destroy its
value, the Postmaster General may pay to the sender or
to any Postal Administration such sum, not exceeding
the sum specified in the Sixth Schedule, as he may
think appropriate if a reasonable claim to such
compensation is, in the opinion of the Postmaster
General, established;
( b ) if any outgoing registered postal article is lost while in
the course of transmission through the post, the
Postmaster General may pay to the sender or to any
Postal Administration such sum, not exceeding the
sum specified in the Sixth Schedule as he may think
appropriate, if a reasonable claim to such
compensation is, in the opinion of the Postmaster
General, established:
Provided that no compensation shall be paid when -
( a ) the loss has occurred through  force majeure , or
through the fault of the sender; or
( b ) the postal article has been confiscated or destroyed by
a competent authority under any law or regulation of
any country or place through which it has been
transmitted; or
( c ) no claim for compensation has been made within a
period of twelve months from the day on which the
postal article was posted or;
( d ) no satisfactory proof of posting is produced.
Compulsory 
registration.
51. (1) If any unregistered postal article having written or
impressed on it or on its envelope or cover the word "Registered",
or any other word, phrase or mark conveying the impression that
the postal article is registered or is intended to be registered, is
found in the post or left at a post office, it shall be registered,
whether or not it is eligible for registration under any other
provision of these regulations.
(2) Where an unregistered postal article is found in the post to
contain -
( a ) any uncrossed money order or postal order in which
the name of the payee has not been inserted; or
( b ) any cheque or dividend warrant which is uncrossed
and payable to bearer; or
( c ) any bearer security; or
( d ) any bank note, currency note or coin being current in

Malta or elsewhere; or
( e ) any unobliterated postage stamps of a total value of
one lira or over; or
( f ) any paper money as is mentioned in paragraphs ( d ), ( e )
and ( f ) of the definition thereof in regulation 2; or
( g ) platinum, gold or silver, manufactured or not, precious
stones and other valuable articles,
it shall be registered, whether or not it is eligible for registration
under any other provision of these regulation.
Surcharge.
registration shall be charged the registration fee and double the
deficient postage, if any, and shall be forwarded to the addressee or
returned to the sender, as the case may be; and any amount of
postage which may have been pre-paid in respect of any postal
article in excess of the ordinary postage shall be reckoned as
payment or part-payment of the registration fee.
(2) When a postal article so surcharged is tendered to the
addressee or sender and he refuses or fails to pay the charges to
which the postal article has become liable, the postal article may be
dealt with or disposed of in such a manner as the Postmaster
General may think fit without prejudice to the Postmaster General’s
right to collect such charges from the sender.
Redirection of 
incoming postal 
articles.
Amended by:
L.N. 138 of 1993.
53. (1) Any incoming postal article, other than a business
reply article, may be re-directed from its original address to the
same addressee at any other address either by an officer of the Post
Office or after delivery at the original address.
(2) An application to the Postmaster General for redirection of
incoming postal articles shall be made on the prescribed form as
shown in the Thirteenth Schedule.
(3) An application to the Postmaster General for redirection of
incoming postal articles shall be signed by the person or persons to
whom the incoming postal articles are addressed, or by the person
having the legal representation of a company, firm or body
corporate or unincorporate in respect of incoming postal articles
addressed to such company, firm or body; or by the person having
paternal authority over, or legal custody of, minor children in
respect of incoming postal articles addressed to such minor
children; or by a person duly authorised by another person in
respect of incoming postal articles addressed to such other person.
(4) Save as the Postmaster General may either generally, or in
any particular case, allow, no application for the re-direction of a
postal article shall be made unless the addressee has actually
changed his address permanently or temporarily:
Provided that if the forwarding address of such a
re-direction request is that of a Post Office private delivery box, the
above provision shall not apply.
(5) No application shall be made for the re-direction of
incoming postal articles addressed to a guest or a resident or an
employee at a hotel, lodging house, club, hospital, institution or

place of work, and if such application is made the Postmaster
General shall not comply with it.
(6) An incoming postal article which is re-directed on the day
of its delivery to its original address or on the day next following
(Sunday and public holidays being disregarded for the purpose)
shall be transmitted by post free of any charge or postage in respect
of such transmission if it is either handed to an officer of the Post
Office or dropped in a post of lice letter box with an indication of
the new address:
Provided that the provisions of this paragraph shall not
apply if before re-direction the incoming postal article has been
opened or tampered with (other than by the substitution of a new
address) or if the name or address of the original addressee has
been rendered illegible:
Provided further that if the incoming postal article is
redirected to a place outside Malta and the amount of postage paid
is insufficient to cover transmission by surface mail to the new
destination, it shall be taxed and treated as an insufficiently
pre-paid postal article:
Provided further that if the original addressee requests that
re-direction be effected by air mail, the incoming postal article
shall be forwarded by air to the new address after being taxed and
treated as an insufficiently pre-paid postal article.
(7) Re-direction shall not be effected in the case of an
incoming postal article which bears on the address side the
instructions of the sender that the postal article is not to be
re-directed, in which case the postal article shall be treated as
undeliverable.
(8) An application for re-direction, or an extension thereof,
shall be valid for a period of twelve months and shall be complied
with upon payment in advance of the charges specified in the Sixth
Schedule.
(9) All applications to extend a period of re-direction must be
made at least fifteen days prior to the expiry date of the existing
re-direction order.
Re-direction of 
registered postal 
articles.
54. When a registered incoming postal article has been
delivered and a receipt obtained in accordance with the provisions
of regulation 47, it shall not be re-directed as provided for in
regulation 53(6):
Provided that the Postmaster General may, in exceptional
circumstances, re-direct the said registered postal article if it is
handed to any officer of the Post Office not later than the day next
following delivery (Sunday and other public holidays being
disregarded for this purpose).
Posting out of 
course.
55. If any registered incoming postal article is, after delivery,
dropped into a letter box for re-direction, it shall become liable to a
surcharge of a single rate of postage and to a fresh registration fee.
Poste Restante. 56. (1) An incoming postal article may be addressed to the
Post Office to be called for, provided it is clearly marked Poste
OVERSEAS POST _g S.L.254.08 19
Restante or "To be called for".
(2) Any incoming postal article marked Poste Restante or "To
be called for" shall bear the full name of the addressee. The use of
initials, figures, fictitious names, or conventional marks of any
kind instead of the name of the addressee is not permissible, and
any incoming postal article so addressed shall be deemed to be
insufficiently addressed and shall be forwarded to the Dead Letter
Office for disposal.
(3) Save as the Postmaster General may otherwise direct, the
Poste Restante service shall be available only to:
( a ) travellers, tourists and foreigners of no fixed abode; or
( b ) persons who reside within an area which is not
accessible for delivery by postman; or
( c ) persons who in the opinion of the Postmaster General
cannot for a good and sufficient reason conveniently
receive their correspondence by postman or through a
private delivery box.
(4) The persons referred to in the preceding subregulations,
other than persons who reside in an area which is not accessible for
delivery by postman, shall not be entitled to have correspondence
delivered at a post office, or addressed to a post office, to be called
for, for a period longer than three months.
(5) The Postmaster General may refuse to deliver any postal
article marked Poste Restante or "To be called for" unless the caller
furnishes proof of his identity and any other particulars that may be
required to identify him as the rightful addressee of the postal
article.
PARCELS
Interpretation.
the following expressions have the meanings hereby respectively
assigned to them:
"postal arrangement" in relation to the transmission by post of
parcels between Malta and any other country, means any treaty,
convention, agreement or undertaking for that purpose between
Malta and such other country, or which applies to both such
countries, or to one of them, or of which both such countries or one
of them are a party;
"cash-on-delivery parcel" means a parcel upon which, in
accordance with a postal arrangement, the Postmaster General or
the Postal Administration of a country or place outside Malta
undertakes at the request of the sender to secure the collection of a
sum of money (in these regulations referred to as a "trade charge")
on his behalf from the addressee as a condition of delivery and
upon which the sender has paid the fee for the cash-on-delivery
service.
Rates of postage.
rates of postage as specified in the Third, Fourth and Fifth
Schedules.
Prohibitions.

to be transmitted by post or delivered by post:
( a ) any parcel which contains any item which is prohibited
to be sent by letter post in terms of regulation 13; or
( b ) any parcel which contains any documents (except
invoices, despatch notes, or advice delivery bills)
having the character of current and personal
correspondence as well as correspondence of any kind
exchanged between persons other than the sender and
the addressee or persons living with them; or
( c ) any parcel which consists of or contains two or more
parcels or other postal articles (of the same or different
description) addressed to different persons at different
addresses; or
( d ) any parcel containing radioactive materials except
where a postal arrangement exists for the transmission
of such materials.
Packing. 60. Every outgoing parcel shall be made up and secured in
such manner as in the opinion of the Postmaster General is
calculated to prevent damage to any other postal article in the
course of transmission or to any receptacle in which the same is
conveyed, or injury to any officer of the Post Office or to any
person who may deal with such parcel. In the event of such damage
or injury the sender shall be liable to pay to the Postmaster General
such reasonable compensation as the latter shall determine.
Limits of size and 
weight.
61. Save as the Postmaster General may either generally or in
any particular case allow, no parcel shall be posted, transmitted or
delivered by post if its size and weight exceeds the maximum sizes
and weights specified in the Seventh Schedule.
Posting of parcels. 62. (1) Outgoing parcels intended to be transmitted by post
shall be posted by being handed over to the appropriate officer at
the counter at the Parcel Post Office or any other Post Office or
Sub-Post Office duly authorised to accept parcels.
(2) At the time of posting of any such parcel, the sender shall
complete any declaration, certificate or document as the Postmaster
General may require, and state on the appropriate form how the
parcel shall be disposed of in case of non-delivery.
(3) A receipt shall be issued for every parcel posted.
(4) Every outgoing parcel shall bear the name and full address
of the addressee, which address shall be written otherwise than in
pencil. The sender’s name and address shall not be written on the
same side as that of the addressee.
Pre-payment of 
postage and fees.
63. (1) Save as otherwise provided in these regulations, or as
the Postmaster General may direct, the postage and fees payable on
every outgoing parcel and the fees payable in respect of postal
facilities shall be pre-paid.
(2) Postage stamps or franking machine impressions denoting
pre-payment of postage rates and postal fees shall be affixed or
printed, as the case may be, on the same side as the address of the
addressee.

Treatment of 
irregular parcels.
64. (1) Any parcel which when in the post is found not to
comply with any provision of law of the country or place in which
the parcel was posted or to which it is addressed, or of any country
or place through which it may pass, or which is not accompanied by
any document required by any such provision, or which is found to
have been posted otherwise than in accordance with regulation 62,
may either be detained or returned to the sender, or dealt with or
disposed of in such manner as the Postmaster General may think fit.
(2) Any incoming parcel which when in the post is found not
to comply with the provisions of regulation 59( c ) shall, if the
Postmaster General thinks fit, be delivered to the addressee subject
to such charge as the Postmaster General may determine in the
particular case, provided that the charge shall not exceed the total
of the charges which would have been payable in respect of each of
the separate parcels or other postal articles contained therein if they
had been posted singly without pre-payment of postage in Malta
and addressed to the country or place of origin of the parcel.
Charges on 
incoming parcels.
65. There shall be charged on every incoming parcel and paid
by the addressee on its delivery the amount of any deficient postage
and any other fees and charges which are payable in respect of the
parcel under any law or regulation in Malta or in any country or
place from or through which the parcel has been transmitted.
Return of outgoing 
parcels.
66. Where an outgoing parcel is received back from a country
or place outside Malta for return to sender, in accordance with the
relative postal arrangement, there shall be charged on the parcel so
received and paid by the sender, whether or not the parcel is
delivered to the sender:
( a ) the amount of any deficient postage and any fees and
charges which are payable in respect of the relative
transmission of such parcel under any law or
regulations of Malta or any country or place through
which the parcel has been transmitted; and
( b ) charges payable in respect of the return transmission at
such rates and such other charges as the Postmaster
General may consider appropriate having regard to the
terms of the relative postal arrangement.
Withholding of 
parcels from 
delivery.
67. The Postmaster General may withhold any incoming parcel
from delivery to the addressee, or any outgoing parcel received
back in the manner described in regulation 66 for return to sender,
until all postage charges and fees have been paid.
Undeliverable 
parcels.
68. (1) An incoming parcel which cannot be delivered or
which has been refused by the addressee or his authorised agent
and an outgoing parcel which is received back from a country or
place outside Malta for return to the sender in accordance with the
relative postal arrangement and which cannot be returned to the
sender, or in respect of which any sums due thereon have not been
paid within such period as the Postmaster General may consider
reasonable, may be dealt with or disposed of as the Postmaster
General may think fit.
(2) Where an incoming insured parcel cannot be delivered, or
delivery of which is refused, the insured parcel shall be returned to

origin as an ordinary parcel.
Delivery of 
parcels.
69. (1) The addressee of an incoming parcel shall be notified
in writing of the receipt of the parcel and shall be requested to
withdraw the parcel during business hours from the Post Office
indicated.
(2) If the addressee fails to withdraw the parcel within thirty
working days from the date of posting of the relative notice
mentioned in subregulation (1), the addressee shall be notified
again by registered post of the receipt of the parcel.
(3) If, notwithstanding the notification by registered post, the
addressee fails to withdraw the said parcel within sixty working
days from the date of posting of the notification mentioned in
subregulation (1), the parcel shall be sent back to sender endorsed
"unclaimed" or dealt with according to the sender’s instructions at
the time of posting.
PARCEL POST FACILITIES
General. 70. (1) The postal facilities relative to parcels referred to in
these regulations shall be provided by the Postmaster General at
such times, during such periods, and at such Post Offices, in such
circumstances, or on such conditions (not being inconsistent with
the provisions of these regulations) as the Postmaster General may
from time to time consider expedient.
(2) There shall be charged on all outgoing parcels the fees
specified in the Sixth Schedule.
(3) The provisions of regulation 34 shall apply  mutatis
mutandis  to parcels.
Air parcels. 71. (1) An outgoing parcel intended for transmission by air
shall bear an "Air Mail" label or be marked conspicuously with the
words "Air Mail" or with such other words as may indicate the
desire of the sender that the parcel be transmitted by an airmail
service.
(2) An outgoing parcel shall be transmissible as an airparcel
only if it is addressed to any country or place to which an air mail
service exists.
Express delivery. 72. (1) Outgoing parcels intended for delivery in a country
whose Postal Administration operates an Express Delivery Service
may bear an express delivery label or be conspicuously marked
with the words "Express Delivery" or with such other words as to
indicate the intention of the sender that the parcels be delivered by
express delivery after their arrival at the appropriate delivery
office.
(2) Where incoming parcels bear an express delivery label or
are conspicuously marked with the words "Express Delivery" or
with such other words so as to indicate the intention of the sender
that the parcels be delivered by express delivery, a notice in writing
of the receipt of the parcel shall be delivered by special messenger
as soon as possible after the arrival in Malta.
Express delivery 
fee.
73. Upon every outgoing parcel marked "Express" there shall
be charged and pre-paid in addition to the postage the fee specified

in the Sixth Schedule.
Cash-on-delivery.
"cash-on-delivery" parcels:
( a ) There shall be charged and paid at the time of posting,
in addition to the postage and any other charges
payable on the parcel, a fee as specified in the Sixth
Schedule.
( b ) The sender shall mark otherwise than in pencil the
cover of the parcel with the word "Reimbursement"
followed by the amount of the trade charge.
( c ) Where the sender is required to complete any
documents, he shall mark thereon, otherwise than in
pencil, the amount of the trade charge.
( d ) The sender shall fill up, otherwise than in pencil, any
other document as required.
( e ) No erasure or correction in the amount of the trade
charge shall be made.
( f ) The Postmaster General shall furnish to the sender a
certificate of posting bearing an acknowledgement that
the "cash-on-delivery" fee has been paid and showing
the amount of the trade charge.
( g ) The Postmaster General shall, upon receiving advice
from the Postal Administration of the country or place
of destination that the trade charge has been collected,
remit the equivalent amount due in Maltese currency
to the sender or a person authorised by him.
(2) The following regulations shall apply to incoming "cash-
on-delivery" parcels:
( a ) The trade charge on an incoming "cash-on-delivery"
parcel shall not exceed the amount specified in the
Tenth Schedule, provided that prior permission of
Exchange Control is obtained.
( b ) There shall be charged and paid on the delivery of the
parcel, in addition to any other sums due thereon, a fee
as specified in the Sixth Schedule.
( c ) The parcels shall not be delivered to the addressee or
opened at his request until the trade charge, the
delivery fee, and any other sums due on the parcel
have been paid.
( d ) The Postmaster General shall, upon receiving the trade
charge from the addressee, remit the amount to the
sender or a person authorized by him through the
Postal Administration of the country or place of origin
of the parcel.
Delivery free of 
charges.
75. (1) Where the relative postal arrangement with another
country or Postal Administration exists, the sender of an outgoing
parcel, other than a "cash-on-delivery" parcel, may request that the
parcel shall be delivered free of customs duty and all other charges
due thereon at the time of delivery. In such cases the following

regulations shall apply:
( a ) The sender shall mark other than in pencil the cover of
the parcel with the words "To be delivered free of
charge" or the words " Franc de droits " or shall affix
thereto the appropriate label.
( b ) The sender shall pay at the time of posting such sum as
the Postmaster General may require as a deposit,
which sum shall amount to not less than 50% of the
declared value, to cover customs duty and other
charges which may be due on the parcel at the time of
delivery.
( c ) The sender shall sign an undertaking to pay to the
Postmaster General on demand the amount of the
customs duty and other charges, less the amount of the
deposit.
( d ) The Postmaster General shall furnish to the sender a
certificate of posting bearing an acknowledgement that
the said deposit has been paid.
( e ) If the deposit paid exceeds the amount of the customs
duty and other charges, the Postmaster General shall
refund the balance to the sender.
(2) Where the relative postal arrangement so provides, the
sender of an outgoing "cash-on-delivery" parcel may request that
the parcel shall be delivered free of customs duty and of all other
charges due thereon at the time of delivery except the trade charge.
In such a case the provision of the foregoing subregulation shall
apply:
Provided that the words to be written on the cover of the
parcel shall be "To be delivered free of all charges except the trade
charge".
Compensation for 
parcels.
76. (1) Subject to the provisions of these regulations:
( a ) if any article forming part of the contents of a parcel is
lost or damaged so as to partly or entirely destroy its
value whilst in the custody of the Postmaster General,
the Postmaster General shall pay to any person who, or
Postal Administration which, in the opinion of the
Postmaster General, establishes a reasonable claim for
compensation such sum not exceeding the sum
specified in the Sixth Schedule, having regard to the
nature of the article, the manner in which it was
packed, and other circumstances;
( b ) if any parcel is lost whilst in the post, the Postmaster
General shall pay to the sender or to any other person
who, or any Postal Administration which establishes a
reasonable claim for compensation a sum not
exceeding the sum specified in the Sixth Schedule:
Provided that compensation shall not be payable in respect
of the loss of or damage to any parcel or any article forming part of
any parcel where:

(i) a claim for compensation on the prescribed form
in the Twelfth Schedule is not received within a
period of one year from the date of posting of
the parcel, either by the Postmaster General or
by the Postal Administration of the country or
place to or from which the parcel was
transmitted, from the person claiming
compensation;
(ii) such loss or damage has occurred due to  force
majeure  or the cause of such loss or damage is
beyond the control of the Postmaster General or
of the Postal Administration of any country or
place under whose administration the parcel is at
the time of such loss or damage;
(iii) the parcel cannot be traced or otherwise
accounted for by reason of the destruction of
official documents and the cause of such
destruction is beyond the control of the
Postmaster General or of the Postal
Administration of any country or place.
(2) Compensation shall not exceed the amount specified in the
relative postal arrangement in the case of an incoming insured
parcel where a postal arrangement exists with the country or Postal
Administration of origin.
(3) The decision of the Postmaster General on all questions
arising on claims for payment in respect of the loss of or damage to
a parcel, or to any article forming part thereof, shall be final.
Re-direction of 
parcels.
77. (1) An incoming parcel may be re-directed from its
original address, to the same addressee at any other address outside
Malta and shall be taxed accordingly:
Provided that:
( a ) the parcel is eligible for transmission to the place or
country of the new address and complies with the
conditions applicable to such transmission; and
( b ) the sender has not forbidden re-direction by means of a
note to that effect on the address side of the parcel in a
language understood at the office of delivery.
(2) An incoming parcel may be re-directed to another address
in Malta without the prepayment of additional postage.
Provided that:
( a ) the sender has not forbidden re-direction by means of a
note to that effect written on the address side of the
parcel in a language understood at the office of
delivery; and
( b ) the provisions of regulation 53 apply for the
re-direction of parcels within Malta.
INTERNATIONAL AND TELEGRAPHIC MONEY ORDERS
Money orders.
international money order or a telegraphic money order to a person

in any country with which a money order exchange arrangement
exists.
(2) International money orders and telegraphic money orders
shall be issued at a Post Office or Sub-Post Office upon application
on the appropriate form.
(3) The amount of the money order to be remitted and the
commission chargeable thereon shall be paid at the Post Office or
Sub-Post Office at the time of issuing the Money Order.
(4) A telegraphic money order allows the sender to transmit
together with the amount of money to be remitted a short message
on payment of additional rates specified in the Eighth Schedule.
(5) For the purpose of these regulations a money order
exchange arrangement means any treaty, convention, agreement or
undertaking between Malta and such other country, or which
applies to both such countries or to one of them, or of which both
such countries or one of them are party thereof, which regulates the
issue, transmission and encashment of money orders through Postal
Administrations.
Minimum and 
maximum 
amounts.

79. The minimum and maximum amounts for which a single
money order may be issued shall be as specified in the Sixth
Schedule, but the remitter may apply for more than one money
order at the same time:
Provided that nothing contained in this regulation shall be
construed as affecting or derogating from any limitation,
restriction, requirement or permission required or imposed by any
law in respect of any payment to the credit of persons residing
outside Malta.
Rates of 
commission.
80. The rates of commission payable on international money
orders and on telegraphic money orders shall be as specified in the
Sixth Schedule.
Encashment. 81. International money orders and telegraphic money orders
shall be encashed at a Post Office or Sub-Post Of fice or through a
bank. In the case where no indication of the Office of payment
appears on the money order, payment may be effected at any Post
Office or Sub-Post Office. If presented for payment at a Post Office
or a Sub-Post Office, payment shall be made to the payee against
his signature on proof of his identity. Crossed money orders are
only payable through a bank. When money orders are presented for
payment by the bank, the formalities referred to in this regulation
shall not be applicable.
Alterations. 82. No alteration may be made in the name of the payee or of
the Office of payment as originally inserted.
Period of validity. 83. An international money order and a telegraphic money
order shall be valid for the period specified in the Eighth Schedule.
Repayment. 84. The amount of an international money order or a
telegraphic money order may be refunded to the remitter at his
request within the period of its validity.
Void money 
orders.
85. An international money order and a telegraphic money
order whose validity has lapsed and which have not been

revalidated shall be refunded to the remitter.
Responsibility of 
the Postmaster 
General.
86. Upon paying an International money order or a telegraphic
money order, by whomsoever presented, the Postmaster General
shall not be liable to any further claim for payment or for
compensation in respect of loss or injury arising out of the delayed
payment of the order or for any other cause whatsoever.
BRITISH POSTAL ORDERS
British postal 
orders.
87. (1) British postal orders issued in fixed denominations in
British currency by the British Postal Administration shall be
purchased at all Post Offices and Sub-Post Offices. Such postal
orders shall be purchased against payment in Maltese currency of
their face value and of the poundage as provided for in regulation
89.
(2) British postal orders are encashed in all Post Offices and
Sub-Post Offices on presentation of proof of identity. Payment
shall be made in Maltese currency.
(3) British postal orders may also be encashed through a bank,
but crossed British postal orders can only be encashed through a
bank.
(4) British postal orders shall only be encashed if duly
stamped by the issuing office.
(5) British postal orders shall not be negotiable.
Maximum amount.
be issued in British postal orders subject to current Exchange
Control Regulations.
Poundage.
of issue the poundage as specified in the Sixth Schedule.
Countries where

90. British postal orders are encashable in the countries

Increase in value.
Post Office or Sub-Post Office may be increased by an amount not
exceeding that specified in the Fifteenth Schedule by affixing
Malta postage stamps, not exceeding two in number on the space
provided on the face of the order.
Period of validity.
the last day of the sixth calendar month following which it is
issued. After the lapse of such period, such order may be
revalidated for a further period of six calendar months.
Conditions of 
payment.
93. A British postal order shall not be encashed if the name of
the person to whom the amount is to be paid is not inserted in the
appropriate space. The purchaser shall retain the counterfoil of the
postal order.
Liability.
the loss or destruction of a British postal order whilst in the custody
of the Post Office unless the counterfoil is produced.
(2) Upon encashing a British postal order by whomsoever
presented the Postmaster General shall not be liable to any further

claim for payment or compensation in respect of that postal order.
Payment to 
purchaser.
95. A British postal order made payable to a person may be
encashed within its period of validity by any other person if
presented for payment together with its relative counterfoil. The
poundage paid at the time of issue is not refundable.
Erasures and 
alterations.
96. No erasure or alteration may be made to the name of the
payee of a British postal order. Payment may also be refused if a
British postal order is presented for encashment in a torn, defaced
or mutilated state.
Refund. 97. An application for the refund of a lost British postal order
shall be made to the Postmaster General and must be accompanied
by the relative counterfoil. Such refund shall be effected after the
period of validity of such postal order has expired.
Limitations. 98. Nothing contained in regulations 87 to 97 shall be
construed as effecting or derogating from any limitation,
restriction, requirement or permission required or imposed by any
law in respect of payments to the credit of persons residing outside
Malta.
INTERNATIONAL REPLY COUPONS
International reply 
coupons.
99. (1) International reply coupons are exchangeable in all
countries for stamps equivalent to the minimum postage charge for
an unregistered surface mail letter. These coupons enable the
addressee to reply without incurring any charges.
(2) International reply coupons are issued at all Post Offices
and Sub-Post Offices against payment of the amount specified in
the Sixth Schedule.
(3) International reply coupons are exchangeable for Malta
postage stamps to the value of the current postage rate for a 20
gram unregistered surface mail letter destined for any country.
Period of expiry. 100. There is no limit to the period of exchange of international
reply coupons.
POSTCHEQUES
Postcheques. 101. Postcheques are instruments which entitle holders to
withdraw from all Post Offices and Sub-Post Offices a maximum
amount in Maltese currency on each postcheque as agreed with the
respective Postal Administration with whom an agreement has been
entered.
Maximum amount. 102. The maximum amount of a single postcheque and the
countries with which an agreement exists are specified in the
Eleventh Schedule.
EXPEDITED MAIL SERVICES
Expedited mail 
service.
103. When a postal article is accepted for transmission by
expedited mail service, the Postmaster General shall bind himself
to deliver the article so posted to the addressee thereof within a
time declared in writing at the time of posting.
Rates of postage. 104. There shall be charged and paid on postal articles accepted
for transmission by expedited mail service the rates of postage
specified in the Ninth Schedule.

Receipt for 
expedited mail.
105. A postal article intended for transmission by expedited
mail must be handed to an official of the Post Office and must be
accompanied by a posting docket duly filled in by the sender. An
official receipt thereof will be issued.
Size and weight.
weight of postal articles intended for transmission by post as
expedited mail shall be those indicated in the Ninth Schedule.
Declaration of 
contents.
107. Postal articles presented for posting by expedited mail
must bear a declaration of the value of the contents and a
description thereof on a prescribed form. In no case shall the value
declared exceed the real value of the contents of the postal article.
Prohibitions.
mail shall contain any coin, bank notes, currency notes or securities
of any kind payable to bearer, travellers' cheques, platinum, gold or
silver, whether manufactured or not, precious stones, jewels, or
other valuable articles, any article which under any law or
regulation is prohibited transmission by post, or any article which
the Postmaster General may from time to time declare as unsuitable
for transmission by post as expedited mail.
Post Office 
liability.
109. (1) Except in cases of loss through  force majeure  the
Postmaster General shall pay an indemnity not exceeding one
thousand liri when it is proved to his satisfaction that a postal
article duly admitted as expedited mail has been lost, damaged or
destroyed whilst in the cutody of the Post Office.
(2) The decision of the Postmaster General on all questions of
compensation payable in respect of postal articles posted as
expedited mail shall be final.
Refund of postage.
paid on a postal article posted as expedited mail in Malta when it is
established that the delivery thereof has been delayed.
Time-limit for 
claims.
111. Any claims for compensation for loss, damage, or
destruction and claims for refund of postage in case of delay in
delivery of a postal article posted as expedited mail must be made
within a period of thirty working days from the date of posting.
Non-liability.
compensation in respect of any consequential loss arising out of the
loss, damage or destruction or delayed delivery of a postal article
admitted as expedited mail.
PENALTIES
Penalties.
order to be sent by post or parcel post, any postal article, parcel or
other thing in contravention of regulation 13(1)( h ), ( i ), ( j ), ( m ) and
( o ) shall be guilty of an offence and shall, on conviction, be liable
to a fine ( multa ) of not less than five liri and not exceeding fifty
liri.
(2) Nothing contained in the foregoing subregulation shall be
construed as affecting any provision of the Act; and the foregoing
subregulation shall not affect the operation of any other law in
respect of an act or omission under such law liable to a punishment
higher than that laid down in this regulation or in respect of any

2. Where a public holiday falls on a weekday, the General Post Office, the
Parcel Post Office, Branch Post Offfices, the Mgarr Post Office, Gozo, the Central
Mail Room and P.O. Boxes / Poste Restante Sections, Valletta shall be kept closed
unless otherwise notified.
3. The General Post Office, the Parcel Post Office, Branch Post Offices, the
Malta International Airport, Post Office, Gudja, the Mgarr Post Office, Gozo, the
Central Mail Room and the P.O. Boxes / Poste Restante Sections, Valletta or any of
them, may be kept closed on any particular day owing to some particular occasion
and the hours of business on any such day in respect of any or all of the said offices
may be different from those set out in the preceding paragraphs.
4. Counter Service at the Parcel Post Office shall close fifteen minutes before
the closing time of the said office.
