REGULATIONS

Citation.
Junior College Regulations.
Status of Junior 
College.
Cap. 327.
2. Subject to the provisions of the Education Act and of these
regulations, the school known as  _Gian Fran _gisk Abela (hereinafter
referred to as the Junior College) appearing in Schedule II to the
Education Act, shall continue as a separate body corporate having
the Statute set out in the First Schedule to these regulations, and
shall be incorporated under that Statute with the University of
Malta.
Exercise of the 
Minister’s powers.

3. The University shall provide the head and teaching staff of
the Junior College who shall be accountable to the Minister in
accordance with article 25 of the Education Act through the Board
of the Junior College established in the Statute of the said Junior
College.
Continuance of 
School Council.

4. (1) There shall continue to be a School Council for the
Junior College as provided in article 23 of the Education Act, and
the said School Council shall continue to have the functions set out
in article 24( a ), ( b ) and ( c ) of the said Act, provided that the School 
Council shall submit the report referred to in paragraph ( c ) of the
said article through the Board of the Junior College established in
accordance with the Statute of the said Junior College.

The Junior College

5. The Junior College shall continue to make use of the
property, moveable and immovable hitherto used by it.
FIRST SCHEDULE
(Regulation 2)
Statute of the  _Gian Fran _gisk Abela Junior College
1. The  _Gian Fran _gisk Abela Junior College, hereinafter
referred to as the Junior College, is hereby incorporated in the
University of Malta, and shall also be responsible for the
Foundation Studies Centre.

2. The aim of the Junior College shall be to initiate students
who have completed secondary schooling in the methods of study
appropriate to tertiary education and to assist them generally in
their personal development.
3. The College shall be governed by a Board.
( a ) The Board shall be composed as follows:
(i) the Rector of the University or his deputy who
shall be the Chairman;
(ii) the Principal of the College, (who shall be ex-
officio Vice Chairman), the Vice-Principal and
the Area co-ordinators appointed in accordance
with this Statute;
(iii) two members elected by and from the academic
staff of the Junior College;
(iv) two members elected by and from the students of
the Junior College;
(v) two members appointed by the Minister
responsible for Education;
(vi) three members appointed by the Senate of the
University from the Humanities area, the
Sciences area and the student representatives on
Senate, respectively;
(vii) the Head of the Academic Division of MATSEC.
The Registrar or his deputy shall be the Secretary of
the Board.
( b ) The Board shall meet at least once every three months.
4. The functions of the Board shall be -
( a ) to propose Regulations to Senate and make bye-laws
as may be required for the attainment of the aim stated
above and to carry out and organise activities ancillary
or conducive to such aim;
( b ) to consider the annual budget for submission to the
Council of the University and monitor the general and
financial administration of the college;
( c ) to recommend to Council of the University nominees
for the posts of Principal, Vice-Principal and area co-
ordinators;
( d ) to appoint subject co-ordinators on the
recommendation of the Principal after consultation
with staff concerned;
( e ) to ensure collaboration with the MATSEC Board, the
Education Division and analogous bodies.
5. (1) The College shall have a Principal and Staff.
( a ) The Principal shall be appointed by the Council of the
University (for a period of four years) from amongst
area and subject co-ordinators on the recommendation
of the Board and shall be responsible for the day to day

administration of the College. The Principal shall be
eligible for reappointment.
( b ) The Vice-Principal shall be appointed by Council of
the University in like manner and shall assist and
deputise for the Principal.
( c ) The area co-ordinators shall be appointed by Council
of the University for a period of four years, on the
recommendation of the Board after hearing a report by
the Principal on his consultations with the subject co-
ordinators concerned. The area co-ordinators shall be
eligible for reappointment.
( d ) The subject co-ordinators shall be appointed by the
Board for a period of four years after hearing a report
by the Principal on his consultations with the staff
concerned. Subject co-ordinators shall be eligible for
reappointment.
( e ) Other academic members shall be appointed by
Council of the University in terms of Statute 7.
( f ) Other non-academic staff shall be appointed by
Council of the University in accordance with Statute 8.
(2) In addition the College shall make use of the services of
the University’s administrative, financial, library and other
operational support staff.
6. Amendments to this Statute may be proposed by the Board
for the consideration and transmission by the Council for the
approval of the Minister responsible for Education.
7. Transitory Clause:
Until such time as the constitution of the Board and the
appointment by Council of the University of a Principal, and Vice-
Principal, subsequent to the recommendations of the Board are
concluded, the said Council may appoint two Vice-Principals
instead of a Principal and a Vice-Principal.
SECOND SCHEDULE
(Regulation 4)

1. (1) The School Council of the Junior College (hereinafter
referred to as "the College Council") shall continue to be
administered according to the Guidelines on the Work and
Administration of School Councils (hereinafter referred to as "the
Guidelines") in Schedule I of the School Council Regulations
(hereinafter referred to as "the principal Regulations") and
according to the Financial Rules for School Councils (hereinafter
referred to as "the Financial Rules") in Schedule II of the principal
Regulations subject to the following adaptations and modifications
applicable to the College Council.
(2) In the Guidelines and in the Financial Rules any reference

to "the Head" or to "the Head of School" shall be read and
construed as a reference to the Principal of the Junior College.
2. (1) The provisions of paragraph 2.1 of the Guidelines shall
not apply to the College Council.
(2) For the purposes of paragraph 2.2 of the Guidelines, if a
member of the College Council resigns from the Council, the
Minister of Education shall be informed in writing by the
Secretary/Treasurer as soon as possible through the Board of the
Junior College (hereinafter referred to as "the Board") and when
the President of the College Council resigns, the resignation should
be sent to the Minister through the Board.
3. For the purposes of paragraph 3.10 of the Guidelines, the
President of the College Council is also to have access to the
Rector of the University.
4. (1) The references in paragraph 4.7 of the Guidelines to
"Department regulations" and to "the Department" shall be read
and construed as references to "University regulations" and to "the
Board" respectively.
(2) The Annual Report referred to in paragraph 4.9 of the
Guidelines shall be submitted to the Minister of Education through
the Board.
5. (1) The funds referred to in paragraph 5.2 of the
Guidelines could also include those passed on to the Junior College
and to the College Council by the University.
(2) For the purposes of paragraph 5.5 of the Guidelines, the
permission of the University shall also be required.
(3) The reference to the Minister of Education in paragraph 5.9
of the Guidelines shall be read and construed as a reference to the
Board.
6. The report referred to in paragraph 7.1 of the Guidelines is
to be sent by the College Council to the Minister of Education
through the Board and the College Council shall be accountable to
the said Minister through the same Board.
7. (1) In paragraph 9.2 of the Guidelines the reference to the
Department of Education shall be read and construed as a reference
to the Board.
(2) For the purposes of paragraph 9.3 of the Guidelines, the
College Council shall alert the Minister of Education through the
Board and any acknowledgement and communication by the said
Minister to the College Council shall therefore also be made
through the Board.
8. Any problems as those referred to in paragraph 10.2 of the
Guidelines shall be reported by the College Council to the Board
through the Secretary Treasurer/Principal.
9. (1) In paragraphs 1.5 and 1.9 of the Financial Rules, the
references to the Director General of Education shall be read and

construed as references to the Board.
(2) Paragraph 1.8 of the Financial Rules shall apply to items
which had not been acquired by the Junior College or by the
College Council through the Education Department or through the
University and in the same paragraph for the words "(vide
Inventory Regulations 5.1)" there shall be substituted the words "of
the University" for the purposes of this Schedule.
(3) In paragraph 1.9 of the Financial Rules, the references to
the Director General of Education shall be read and construed as
references to the Board.
10. (1) Paragraph 2.1 of the Financial Rules shall not apply to
the College Council.
(2) The accounts mentioned in paragraph 2.4 of the Financial
Rules shall be rendered to the Minister of Education through the
Board.
(3) The financial records of the College Council shall be
available for tne purpose of paragraph 2.6 of the Financial Rules
through the Board.
11. In paragraph 3.1 of the Financial Rules, references to the
Director General of Education shall be read and construed as
references to the Board and the reference in subparagraph (iv)
thereof to the issue of a departmental or Treasury call for tenders
shall not apply.
