PROTECTION OF PUBLIC GROUNDS 
( _HAMRUN LOCAL COUNCIL) BYE-LAWS
22nd September, 1995
LOCAL COUNCIL BYE-LAW 27/3/95.
Citation .
Grounds ( _Hamrun Local Council) Bye-Laws.
Interpretation.
"bicycle" includes a tricycle or other pedal-driven cycle
irrespective of the number of wheels;
"Council" means the  _Hamrun Local Council;
"fixtures and furnishings" means any barrier, railing, post, seat,
flower pot, equipment, apparatus or facility and any other
ornament, structure or other thing fixed or placed in a public
ground;
"public ground" means any public open space and any public
garden, playing field or other public place intended for use or
recreational purposes by the public and includes pavements,
pedestrian passages or other pathways but does not include any
space which although within the  _Hamrun locality boundary does
not fall within the authority or administration of the Council or
street or other place used or allowed to be used for the passage or
parking of motor vehicles.
Tampering with 
fixtures and 
furnishings.
3. No person shall remove or displace, unless so authorised,
or misuse, cause any damage or in any way tamper with any
fixtures and furnishings placed or erected in any public ground.
Protection of 
flower beds, etc.
4.1 No person shall, in any public ground, enter upon, pick,
misuse or otherwise cause damage to:
4.1.1 any flower bed, shrub, plant, tree or other vegetation
or any part thereof; or
4.1.2 any part of the ground intended for the sowing or
renovation of grass, turf or other vegetation, where
adequate notice has been set up to keep off from any
such part of the ground.
Prohibition of 
bicycles in public 
grounds.
5. No person shall ride any bicycle in a public ground, or in a
part of such ground, where a sign has been set up to prohibit the use
of a bicycle.
Prohibition of 
certain activities.
6.1. No person shall in any public ground, play any game or act
in such manner -
6.1.1 as to give reasonable cause for annoyance to any
other person in the public ground; or
6.1.2 as is likely to cause any damage to any flower bed,
shrub, plant, tree or other vegetation or to fixtures

and furnishings contained in the public ground.
Removal of 
offender.
7. Without prejudice to any other action which may be taken
in accordance with these bye-laws, any person who fails to comply
with any of the provisions of these bye-laws may be removed from
the public ground by a police of officer or by any other person
acting under the authority of the Council. 
Offences and 
penalties.
8.1. Any person who contravenes or fails to comply with any of
the provisions of these bye-laws, shall be deemed to have
committed a contravention and shall, on conviction, be liable,
unless a higher penalty is applicable under any other law -
8.1.1 for a first offence to a fine ( ammenda ) of twenty liri;
8.1.2 for a second offence to a fine ( ammenda ) of thirty
liri; and
8.1.3 in the case of a continuing offence to a fine
( ammenda ) of five liri for each day during which the
offence continues.
Civil damages. 9. The imposition of a penalty under bye-law 8 shall be
without prejudice to the right of the Council to recover any civil
damages caused by the commission of the contravention under
these bye-laws.
