SKIPS (SLIEMA LOCAL COUNCIL) BYE-LAWS

Citation .
Council) Bye-Laws.
Interpretation.
"authorisation" means the authorisation given by the Council as
provided in bye-law 4.1;
"authorised person" means any person given a authorisation by
the Council in accordance with the provisions of bye-law 4.1;
"commercial waste" means any waste originating from shops,
restaurants, enterprises, organizations, hotels and other
establishments operating in commerce but does not include
domestic and/or industrial waste;
"Council" means the Sliema Local Council:
"domestic refuse" means any household waste originating from
private dwellings including apartments and residential homes, but
does not include commercial and/or industrial waste;
"industrial waste" means any bulky refuse originating from
workshops, factories or contractors engaged in construction work,
but does not include domestic and/or commercial waste;
"skip" means any type of recipient which is closed or open,
whether on wheels or not, whether made of metal or any other
material which is used for the purpose of depositing domestic,
commercial or industrial waste.

commercial and/or 
industrial waste.
3.1.1 The skips used for the deposit of commercial and/or
industrial waste shall at all times be kept within the boundaries of
the property from which the waste originates. These shall be taken
out only at the time when they are going to be emptied.
3.1.2 No authorisation shall be given by the Council for a skip
used for commercial or industrial purposes to be placed in any
public place.
Offences and 
penalties.
3.2 The Council may order the removal from any public place
of skips used for commercial and/or industrial waste, and if the
owner of the commercial and/or industrial enterprise refuses to
abide by the Council’s orders, he shall be deemed to have
committed a contravention and shall, on conviction, be liable,
unless a higher penalty is applicable under any other law -
3.2.1 for a first contravention to a fine ( ammenda ) of
twenty liri (Lm 20), and
3.2.2 for a second or subsequent contravention to a fine
( ammenda ) of thirty liri (Lm 30).

Authorisation for 
skips to be used for 
domestic waste.
4.1 Any person who requires to use a skip for the deposit of
waste originating from reconstruction works carried out on a
domestic household, shall apply for authorisation by the Council.
4.2 The application shall be made on the form prescribed in
Schedule A.
4.3 Any authorisation given by the Council is valid for a
period of seven days which shall run from the date indicated in the
application.
4.4 If the applicant requires to use the skip for a period
exceeding seven days, he is required to make a fresh application
every time the authorisation expires.
4.5 A fee of ten liri (Lm 10) for every skip shall be made with
every application.
4.6 The authorised person shall abide by the conditions
established in Schedule B and to any other conditions which the
Council deems appropriate.
4.7 The Council may revoke any authorisation given under
these Bye-Laws if it is satisfied that any of the conditions under
which the authorisation is given is breached by the authorised
person, or if there are substantial changes in circumstances which
in the opinion of the Council deems it necessary to revoke such
authorisation
4.8 If the authorisation is revoked by the Council as provided
in the preceding bye-law, the Council shall not be obliged to refund
the fee paid on application.
Provisions do not 
apply to skips used 
in the execution of 
the Council’s 
functions.
5. The provisions laid down by these Bye-Laws do not apply
to skips used by contractors of the Council in the execution of
services forming part of the statutory functions of the Council.

Note: This authorization is subject to the conditions established in the Bye-Laws
and also to such conditions as the Council may deem appropriate to impose
on such authorised person when the authorisation is given.

SCHEDULE B
(Bye-law 4.6)
Conditions for the Use of Authorised Skips
1. The skip shall be placed in front of the property from which domestic waste
shall originate, or as indicated by the Council Secretary.
2. The authorised person shall ensure that the skip is emptied as soon as it is
full.
3. The authorised person shall ensure that in the use of the skip the
environment is safeguarded, mainly by keeping the area surrounding the
skip clean and by not depositing in the skip material which has a foul smell.
4. The authorised person shall ensure that when using the skip no damage is
done to the property or limb of third persons.
5. The authorisation is without prejudice to any other permit, authorisation or
licence which applicant would be required to obtain under any other law.
6. The authorisation is valid for a period of seven days as indicated in the
authorisation.
7. These conditions are without prejudice to any other conditions which the
Council may deem necessary in the circumstances. These conditions
(together with the additional conditions made by the Council) shall be given
to the authorised person when the authorisation is given.
