Titolu. 1. It-titolu ta’ dawn ir-regolamenti hu r-Regolamenti dwar
Bastimenti ta’ Taghbijiet Perikoluzi, Terminals u Facilitajiet
Marittimi u Bunkering.
Ghan. 2. Dawn ir-regolamenti jirregolaw il-moviment, it-
trasferiment, il-magazzinagg u l-manigg ta’ taghbijiet perikoluzi,
bunkers, xoghlijiet ta’ saborra u tnaddif tat-tankijiet fuq il-
bastimenti kollha u fit-terminals u l-facilitajiet marittimi kollha fi
jew konnessi ma’ l-ibhra interni u territorjali ta’ Malta.
Tifsir. 3. F’dawn ir-rego1amenti, kemm-il darba r-rabta tal-kliem ma
tehtiegx xort’ohra:
"area dikjarata hielsa mill-periklu" tfisser kull area fuq bastiment

minn barkun tal-bunkers licenzjat jew awtorizzat biex jissupplixxi
bunkers, li jkunu jimmaniggaw jew ikunu ghabbew jew bi
hsiebhom jghabbu taghbija li kollha kemm tkun jew parti minnha
tkun tikkonsisti f’taghbijiet jew sustanzi perikoluzi kif deskritti fit-
tifsir ta’ taghbijiet perikoluzi, taghbijiet perikoluzi ppakkjati, u
sustanzi, in massa jew f’kontenituri, jew li jkunu hattew xi prodott
minn dawk, jekk l-ispazji tat-taghbija ma jkunux iccertifikati hielsa
mill-gass;

ghandhom jinhargu suggett ghall-kondizzjonijiet li jkunu
jipprevalu fiz-zmien ta’ l-ittestjar u ghal perijodu specifikat ta’
validita ;
"cold work permit" tfisser certifikat li jippermetti li jsir xoghol

"combination carrier" tflsser bastiment kostruwit jew adattat
biex igorr jew pitrolju likwidu jew dry cargoes in massa;
Kap. 352.
"Direttur" tfisser id-Direttur Ezekuttiv responsabbli ghall-
portijiet mahtur taht l-artikolu 8 ta’ 1-Att dwar l-Awtorita
Marittima ta’ Malta, jew kull persuna jew ufficjal iehor li jkunu
awtorizzati minnu biex jagixxu f’ismu;
"dwal mikxufa" tfisser kull sors mhux konfinat li jista’ jaghti n-
nar u tinkludi:
(i) kull materjal inkandexxenti espost bhal nar,
dawl mikxuf, welding u burning torches, u
sigaretti, sigarri, pipi, lighters tas-sigaretti jew

"electrical isolation certificate" tfisser certifikat li jinhareg meta

sabiex jiksbu servizzi bhal tnaddif tat-tankijiet, tnehhija ta’ slops/
residwi, tiswijiet, bunkers, servizzi ta’ kostruzzjoni tal-bastimenti u

Generali. 6. (1) Tkun ir-responsabbilta  tal-persuni specifikati fir-

tat-taghbija jew sustanzi ohra u jiehu hsieb li dawn jittiehdu biex
jigu ttestjati f’dawk il-postijiet u f’dawk il-hinijiet li d-Direttur
jista’ jistabbilixxi. Il-Kaptan, is-sid jew operatur, l-interessi fit-

27. Tanker li jkun iccertiflkat li jkun inert ghal kollox u/jew

hielsa mill-gass u l-bqija inerti, jista’ jidhol il-Port il-Kbir sabiex
imur ghal facilita  ta’ tiswija, sakemm ikun ukoll sar dan l-iccekkjar
addizzjonali ta’ sigurezza minn persuna kompetenti:
(a) il-gas-tightness tas-sistema tad-distribuzzjoni ta’ gass
inert u tat-tankijiet tat-taghbija tkun ikkonfermata, u li
jkun affermat bid-dikjarazzjoni bil-miktub tal-Kaptan,

(a) kif jasal, ghandhom jigu mimlija c-checklists rilevanti
kif specifikati fl-Iskeda B;
(b) qabel ma jinbeda x-xoghol ta’ tiswija u mhux anqas
minn darba kull erbgha u ghoxrin siegha wara dan -
izda f’kull kaz minnufih wara li s-sistema tal-pressjoni
tat-tank tkun giet mimlija b’gass inert - persuna
kompetenti akkumpanjata minn ufficjal responsabbli
tal-bastiment ghandhom, flimkien, jiccekkjaw li l-
livell ta’ l-ossigenu f’diversi livelli differenti gewwa
sew kull kompartiment inertjat ma jkunx tala’ aktar
mill-massimu ta’ 8% f’li hu volum, li l-pressjoni tkun
mizmuma f’minimu ta’ 100mm fuq il-water gauge u li

(c) il-gas-tight seals ta’ l-aperturi kollha tal-

ebda spazju inertjat ma jista’ jinfetah ghall-atmosfera
hlief ghall-iqsar perijodu mehtieg biex isir testjar,

(e) kulmeta jkun mehtieg, il-facilitajiet ta’ tiswija
ghandhom jipprovdu provvista kontinwa ta’ ilma
ghad-deck water seal u gass inert ta’ kwalita  adatta
minn generatur ta’ gass inert ta’ fuq l-art. F’kull kaz,
qabel tinbeda xi tiswija, ghandha ssir konnessjoni bejn
il-generatur ta’ gass inert tal-facilita  u d-delivery main
ta’ gass inert tat-tanker;
(f) il-konnessjonijiet, cables u proceduri kollha uzati biex
jipprovdu provvista addizzjonali ta’ l-elettriku lil
bastiment minn fuq l-art ghandhom ikunu strettament
skond il-htigiet kollha ta’ l-Istrumenti Rilevanti,
inkluz il-provdiment ta’ mezzi approvati f’kull
terminal board fil-bastiment li mieghu tkun imqabbda
provvista ta’ l-elettriku minn fuq l-art, sabiex il-
provvista minn fuq l-art ma tkunx tista’ tigi mqabbda
mas-switchboard waqt li tibqa’ mqabbda mal-
generaturi tal-bastiment;
(g) il-permessi ghal xoghol bis-shana, xoghol bil-kiesah,
xoghol elettriku u l-permessi ta’ dhul ma ghandux

tat-tankijiet ghandu jsir strettament skond il-htigiet ta’ l-Istrumenti
Rilevanti.
(3) Kif jasal fl-irmigg tat-tnaddif tat-tankijiet, ic-checklists

f’dawn ir-regolamenti, il-preparamenti kollha ghal u x-xoghol,
proceduri u metodi attwali ta’ manigg ta’ taghbijiet u/jew ta’
saborrar, fuq taghbijiet perikoluzi gewwa l-ibhra ta’ Malta
ghandhom kontinwament u konsistentement ikunu b’osservanza
shiha u skond il-htigiet ta’ l-Istrumenti Rilevanti, b’attenzjoni
specjali ghal dawk li jinsabu fl-ISGOTT u l-gwidi rilevanti ta’ l-
OCIMF.
(3) Jekk f’xi hin waqt li jkun qieghed isir dak ix-xoghol ma
tkunx tista’ tigi sostnuta xi htiega tas-subregolament (2), f’kaz bhal
dan ix-xoghol ta’ manigg tat-taghbijiet u x-xoghol ta’ saborrar
ghandu jieqaf minnufih u s-sistemi ta’ manigg ta’ taghbijiet u
saborrar, kemm dawk tal-bastiment u dawk ta’ fuq l-art, ghandhom
jinghalqu u d-Direttur ghandu jigi mgharraf.
(4) Ebda xoghol ta’ manigg ta’ taghbijiet u/jew ta’ saborrar ma
ghandu jerga’ jinbeda qabel ma dawk il-kondizzjonijiet preskritti
jkunu gew stabbiliti mill-gdid kif ghandhom ikunu u
kompletament. Id-Direttur jista’ f’kull hin jordna lit-tanker biex
jitlaq mill-ibhra ta’ Malta.
(5) Qabel il-bidu ta’ kull xoghol ta’ manigg ta’ taghbijiet (kif
ukoll qabel il-bidu tal-fazijiet separati integrati f’kull bicca xoghol)
ghandhom jigu mimlija c-checklists u d-dikjarazzjonijiet rilevanti
kif specifikati fl-Iskeda B, skond ix-xoghol li jkun sejjer isir.
(6) La c-checklists ta’ flimkien u lanqas id-dikjarazzjonijiet ma
ghandhom jigu ffirmati, u lanqas ma ghandu jinbeda xi xoghol,
qabel ikun hemm assigurazzjoni reciproka dwar is-sezzjonijiet
rilevanti. Certi hwejjeg ta’ fuq ic-checklists ikunu jehtiegu li jigu
ccekkjati diversi drabi jew jigu sorveljati kontinwament tul ix-
xoghol kollu ta’ manigg ta’ taghbijiet u ta’ saborrar.
(7) Ghar-rigward ta’ proceduri miftiehma li jkunu ppjanati
minn qabel ghall-manigg ta’ taghbijiet, bunkers u saborra, jekk
jinstab li xi zviluppi sussegwenti jkunu jistghu jaffettwaw dak ix-

personal ta’ fuq l-art biex jesegwixxu bla periklu u jikkontrollaw
b’mod sufficjenti x-xoghol mehtieg.
(10) Ebda tanker ma jista’ jaghmel xoghol ta’ manigg ta’
taghbijiet fuq taghbijiet perikoluzi fil-Port il-Kbir jew fil-Port ta’

jinzammu fi stat tajjeb ta’ thaddim u l-Kaptan u l-
ekwipagg ghandhom ikunu imharrga sewwa fl-uzu u l-
pozizzjonar effettiv taghhom;
(i) il-manek kollha u kull apparat iehor li jintuza ghal
xoghol ta’ bunkering, il-mod ta’ kif dawn jithaddmu u

Declaration
We have checked, where appropriate jointly, the items on this check list, and have
satisfied ourselves that the entries we have made are correct to the best of our
knowledge, and arrangements have been made to carry out repetitive checks as
necessary.
Application
The Check List applies to the cargo handling operations of oil tankers, chemical
carriers and gas tankers and is divided into three parts.
Part A - General - (all tankers)
Part B - Additional - (chemical tankers handling chemicals)
Part C - Additional - (gas tankers handling liquefied gases)
All tankers - oil, chemical and gas, should complete Part A. Additionally, tankers
loading or discharging bulk chemicals should complete Part B and gas tankers
loading or discharging liquefied gases should complete Part C. The declaration at the
end of the Check List shall be made in all cases.
The Mutual Safety Examination
A tanker presenting itself to a loading or discharging terminal needs to check its
own preparations and its fitness for the safety of the intended cargo operation.
Additionally, the master of the ship has a responsibility to assure himself that the
terminal operator has likewise made proper preparations for the safe operation of his
terminal.

considerations which should be included in such a mutual examination.
Some of the Check List’s questions are directed to consideration for which the
tanker has prime responsibility. Others apply to both tanker and terminal and the
remainder to the terminal alone. It is not suggested that every item should be the
subject of personal checking by both representatives conducting the examination.
All items lying within the responsibility of the tanker shall be personally checked
bv the tanker’s representative and similarly all items of the terminal’s responsibility
personally checked bv the terminal representatives. In discharge of their full
responsibilities however, both representatives, by questioning the other, by sighting
of records and, where felt appropriate, by joint visual inspection shall assure
themselves that the standards of safety on both sides of the operation are fully
acceptable.
The joint declaration shall not be signed until such mutual assurance is achieved.
Thus all applicable questions should result in an affirmative mark in the boxes
provided. If a difference of opinion arises on the adequacy of any arrangements
made or conditions found, the operation shall not be started until measures taken are
jointly accepted.
A negative answer to the questions coded "P" does not necessarily mean that the
intended operation cannot be carried out. In such cases, however, permission to
proceed must be obtained from the Executive Director (Ports).
Where an item is agreed to be not applicable to the ship, to the terminal or to the
operation envisaged a note to that effect shall be entered in the "Remarks" column.
While the Check List is based upon cargo handling operations it is required that
the same mutual examination, using the Check List as appropriate, be carried out
when a tanker presents itself at a berth for tank cleaning after carriage of substances
covered by these regulations.
Deviations
The conditions under which the operation takes place may change during the
process. The changes may be such that safety or pollution prevention can no longer
be regarded as guaranteed. The party noticing or causing the unsafe condition is
under an obligation to take all necessary actions. which may include stopping the
operation, to re-establish safe conditions. The presence of the unsafe condition shall
be reported to the other party and where necessary co-operation with the other party
shall be sought.
