MIGRANT WORKERS (CHILD EDUCATION) 
REGULATIONS

Citation and 
applicability.
1. (1) The title of these regulations is the Migrant Workers
(Child Education) Regulations.
(2) These regulations shall apply to the children of migrant
workers of compulsory school age.

2. In these regulations, unless the context otherwise requires -
''Agreement'' means an agreement between states or between
groups of states to which Malta is a party, reciprocally granting to
citizens of such states or their dependents the right to enter, remain
and reside in and leave the country of such state, to move freely
within such states for such period as may be established in the
agreement and to work or establish, provide or receive services
therein; and ''Agreement State'' and ''citizen of an Agreement State''
shall be construed accordingly; and where a state is a party to such
an Agreement subject to modifications and adaptations, a citizen of
an Agreement State shall also be subject to such modifications or
adaptations as may be prescribed;
''children of migrant workers'' means any child residing in Malta
for whom school attendance is compulsory under Maltese law and
who is a dependent of a migrant worker;
''migrant worker'' means any person who carries out or has
carried out an activity in Malta as an employed or self-employed
person who is a citizen of an Agreement State;
''Minister'' means the Minister responsible for education;
''State school'' means any state financed, controlled and managed
school for students of compulsory school age;
''teacher'' means any person holding a valid teacher's warrant
who is employed by a recognized educational establishment to
teach children of compulsory school age.

3. (1) It shall be the duty of the State to take appropriate
measures to ensure that free tuition is given to children of migrant
workers in a State school in order to facilitate their initial reception
in the educational environment and the school system of Malta as
the host State, including, in particular, the teaching, as adapted to
the specific needs of such children, of any of the official languages
Malta.
(2) The State shall take measures, within reasonable limits, to
facilitate the eventual re-integration of the children of migrant
workers into their Agreement States of origin, by promoting the
teaching of both the mother tongue and the culture of the country of

origin of such children in cooperation with such country of origin.
Provision of 
teacher training.
4. The Minister shall take all necessary measures for the
adequate training of teachers providing tuition to the children of
migrant workers.
