DEGREE COURSE REGULATIONS

LEGAL NOTICE 21 of 1995, as amended by Legal Notices 11 and 180 of
1997, 8 of 1999, 20 and 116 of 2000, 143 of 2001 and 36 of 2002.
Citation and 
interpretation.
1. (1) The title of these regulations is the Bachelor of Arts in
Legal and Humanistic Studies - B.A. Leg. & Hum. St. - Degree
Course Regulations.
(2) In these regulations, unless the context otherwise requires -
"the course" means the course leading to the Degree of Bachelor
of Arts in Legal and Humanistic Studies - B.A. Leg. & Hum. St.;
"the Degree" means the Degree of Bachelor of Arts in Legal and
Humanistic Studies - B.A. Leg. & Hum. St.;
"the Board" means the Board of the Faculty of Law.
Applicability.

2. These regulations shall be applicable for courses starting in
October 2004 or later.
Eligibility for the 
Degree.
3. To be eligible for the Degree a candidate shall:
( a ) be registered as a matriculated student in terms of the
Admission Regulations of the University;
( b ) complete the course of studies, qualify in the
examinations and satisfy any other requirements
prescribed in these regulations; and
( c ) satisfy any other requirements prescribed in any other
relevant statutes and regulations of the University.
Special course

4. (1) To be registered for the course a candidate shall, in
addition to satisfying the conditions specified in the Admission
Regulations of the University, be in possession of passes in two
subject at Advanced Level at Grade C or better chosen from Groups
1, 2, 3 or Computing/Information Technology (Group 4) of the
Matriculation Certificate Examination.
(2) A candidate who is a graduate of a University, or has other
qualifications considered to be sufficient, may be exempted by the
Admissions Board, on the advice of the Faculty Admissions
Committee, from the whole or part of the aforesaid special course
requirements.

Course structure. 5. (1) The programme of studies shall extend over three
years, and shall be divided into two parts: Part One and Part Two.
(2) To complete the course candidates shall follow courses in
two areas of studies, one of which must be Law, and the other an
area of study approved by the Board.
(3) The Board may require candidates to register before each
year of the course for those study-units indicated by it.
(4) The Board shall draw up a schedule of study-units in the
Law area and the credits assigned to each. The Board may amend
such schedule from time to time as it may deem advisable, provided
this is done before the beginning of the academic year.
(5) A candidate who takes study-units in areas of study in
another Faculty shall satisfy its regulations relevant to that area of
study and, for the purpose of obtaining credits in those study-units,
satisfy the assessment criteria in that Faculty.
(6) The Board may exempt a candidate from the requirement
of obtaining a credit if he has obtained from the University of
Malta, or an institution recognised by the Senate for the purpose, a
qualification the study for which is, in the opinion of the Board, at
least equivalent in content and standard to that required for the
credit concerned.
Part One of course.

6. (1) Part One will extend over the first year of the course.
To complete Part One of the course and proceed to Part Two a
candidate shall obtain a minimum of 22 credits, of which at least 14
must be in the Law area and at least 8 shall be in the other area of
study chosen, and pass an end of year examination in the Law area.
(2) In special circumstances, a candidate may be allowed by
the Board to obtain not more than 2 of the 8 required credits in the
other area of study chosen in Part Two of the course.
Part Two of 
course.
7. (1) Part Two of the course shall extend over the second
and third years. To complete Part Two of the course the candidate
shall obtain a minimum of 50 credits of which at least 28 shall be in
the Law area and at least 16 must be in the other area of study
chosen.
(2) A candidate who during the first year of Part Two fails to
obtain a minimum of 25 credits, of which at least 14 shall be in the
Law area and at least 8 shall be in the other area of study, shall not
be allowed to proceed to the final year of the course.
(3) A candidate who has obtained the minimum number of
credits as prescribed by subregulation (1) shall be required to sit, at
the end of Part Two of the course, the final examinations as
provided in regulation 9.
(4) Before being awarded the Degree a candidate shall obtain
the minimum number of credits and pass in all the examinations in
accordance with these regulations.
Progress. 8. (1) Credits shall be assigned according to the following
grades in descending order of merit: A, B, C, D and F where F
indicates Fail.
(2) A candidate who fails to obtain a credit for a study-unit

shall be allowed to be re-tested only once. In the re-assessment, the
student’s credit shall be graded either D or F.
(3) A candidate who in terms of regulation 6 or regulation 7(2)
is not allowed to proceed to the next year of the course, may be
allowed by the Board to rejoin the course once only in terms of
regulation 13.
Final 
examinations.

9. (1) Final examinations shall be held at the end of Part Two
of the course, normally in June, and shall consist of one paper in
each of the subjects in the Law area of study covered during Part
Two of the course and two papers in the second area of study,
provided that, whenever it deeems necessary, the Board of
Examiners for any paper may also require a candidate or candidates
to submit to a  viva voce  examination.
(2) To satisfy the final examination requirement, a candidate
shall be successful in each subject in the Law area of study and in
each paper in the second area of study. Regulation 8(1) shall
mutatis mutandis  apply.
(3) A candidate who fails in any one or more of the subjects
shall have a supplementary session  in September in the failed
subject or subjects.
(4) The mark or grade obtained in a supplementary
examination shall either be the minimum pass mark or grade, or
Fail.
(5) The Board of Examiners shall issue a notice calling the
students to the  viva voce  examination at least three days prior to the
viva voce  examination.
Final grading.
his performance in the final examinations as well as the credits and
grades obtained during his course of studies.
(2) The examination after the end of Part One shall carry ten
per cent (10%) of the weighting and the final examinations shall
carry fifty per cent (50%) of the weighting for the grading of the
final result. The other forty per cent (40%) shall be calculated on
the basis of an overall average of the credits obtained. If more than
75 credits are obtained by a candidate the best 75 credits satisfying
regulation 6 and regulation 7(1) shall be taken into account.
(3) In the final results the names of candidates who qualify for
the Degree shall be published in alphabetical order in categories I,
IIA, IIB and III.
Admission to Post-
graduate courses.
11. Candidates who qualify for the Degree in such manner as
may be prescribed by the regulations relevant to the degree of
Doctor of Laws or any other post-graduate degree in Law or in their
other area of study shall be allowed to register for such course.
Diploma of Legal 
Procurator (L.P.).

12. (1)  Candidates who qualify for the Degree and whose
credits in the Law area include a minimum of 35 credits in those
study-units indicated by the Board for the purpose, shall also be
entitled to the Diploma of Legal Procurator (L.P.).
(2) Saving the provisions of subregulation (1), candidates who
have obtained the Degree may register subsequently for the

Diploma of Legal Procurator.
(3) The programme of studies of candidates registered under
subregulation (2) shall extend over one year and candidates shall be
required to register for a minimum of 15 and a maximum of 25
credits in law as indicated by the Faculty Board, with particular
reference to those credits dealing with the law of procedure.
(4) A candidate registered under subregulation (2) shall be
admitted to the diploma only if:
( a ) he obtains the minimum number of credits as specified
in subregulation (3); and
( b ) he satisfies a final examination consisting of one paper
and a viva voce examination in each of the subjects in
the law area of study covered during the year.
Rejoining of 
course.

13. (1) A candidate who has interrupted his course of studies
or who has failed in a particular year may be allowed by the Board
to rejoin the course in such year as the Board may deem appropriate
and in so doing the Board may require such candidate to sit for such
further examinations, besides those specified in regulation 9(1), as
it may deem necessary.
(2) The Board shall, in no case, allow a candidate to complete
his course of studies in a period longer than four years. In special
circumstances, Senate may allow a further extension of one year,
on the recommendation of the Board.
(3) Candidates who were following the LL.D. course under the
regulations immediately in force prior to the present regulations,
and had interrupted their course of studies or failed in any
particular year may be allowed to join the course under these
regulations in such year as the Board may deem appropriate, and in
so doing the Board may require such candidates to sit for such
funkier examinations, besides those specified in regulation 9(1), as
it may deem necessary.
Transitory 
provision.

14. Regulation 12(2), (3) and (4) shall apply to all candidates
registering for the diploma as from the 1st October 1996.
