LOCAL COUNCILS (DELEGATION OF FUNCTION) 
(BUS SHELTERS) ORDER

Citation.

Interpretation.
Cap. 363.
"bus shelter" means any roofed structure, sited near a location
designated by the competent authorities for the collection of
passengers by motor buses that are employed as public transport
vehicles, and which structure is intended primarily for the
convenience and protection of such passengers;
"bus stop" means any location designated by the Malta Transport
Authority for the purpose of serving as a bus stop for the purposes
of the public transport;
"Council" means a Local Council established under the Act;
"locality" has the same meaning assigned to it by the Act;

"Malta Transport Authority" means the Malta Transport
Authority as established in the Malta Transport Authority Act;
"Minister" means the Minister responsible for Local
Government.

3. In terms of article 33(1)( n ) of the Act, the Minister has
directed that:
( a ) the erection and replacement of all new bus shelters,
and
( b ) the maintenance of all bus shelters,
shall be a function which is hereby delegated to each Local Council
in relation to its locality.

distributor roads,

4. In terms of article 33(2) of the Act, the responsibility for
arterial and distributor roads and the items shown in the Schedule is
being delegated to Local Councils solely for the purposes provided
for in article 3 of this Order:
Provided that the delegation for the arterial and distributor
roads mentioned above should not exclude concurrent central
government authority to replace bus shelters as necessary when
required.

Replacement of 
structure of bus 
shelter.
7. In the case of replacement of a bus shelter in existence
prior to the publication of this Order, a Council shall give notice in
writing of its intention to the Malta Transport Authority of at least
ten days, and the Malta Transport Authority shall advise the
Council in writing whether the structure to be replaced is to be
disposed of by the Council itself or by the Malta Transport
Authority:
Provided that if the Malta Transport Authority fails to
advise the Council as provided in this article, such structure shall
become the property of the Council and the Council shall, at its
expense, have the right to dispose of such structure as it deems fit.
