ELECTRONICS INDUSTRY WAGES COUNCIL
WAGE REGULATION ORDER
5th May, 1977

Title.
Council Wage Regulation Order.
Field of operation 
of Wages Council.
2. The provisions of the Schedule to this Order shall apply to
all employees in respect of whom the Electronics Industry Wages
Council operates.

SCHEDULE
Interpretation.
"customary holidays" means the days (other than Sundays)
declared for the time being to be public holidays by or under the
National Holidays and other Public Holidays Act;
"day" means a period running from midnight of one day to
midnight of the next following day;
"half-day" means a period running from midnight to noon, or
from noon to midnight;
"hours of work" means the time on any day during which
employees are at the disposal of the employer, exclusive of the
intervals allowed for meals and rest;
"part-time employee" means an employee who is not a whole-
time employee;
"shift employee" means an employee who regularly works on a
shift cycle basis;
"time-and-a-half" and "double-time" mean respectively one and a
half times and twice the minimum time rate applicable to the
employee;
"wages" means remuneration or earnings, payable in money by
an employer to an employee;
"week" means a calendar week;
"weekly day of rest" means a period of twenty-four consecutive
hours commencing at the time at which the employee would
normally commence his turn of duty;
"whole-time employee" means an employee who works for more
than thirty hours in any one week.

Hours of work. 2. The minimum weekly remuneration shall be related to a
normal working week of not more than - 
( a ) forty hours spread over five days in the case of all
whole-time employees other than watchmen/security
guards and shift workers;
( b ) fifty-four hours in the case of watchmen/security
guards;
( c ) thirty-eight hours spread over five days in the case of
shift workers:
Provided that, in the case of shift employees, the number of
hours shall be taken on an average spread over two or more weeks
according to the number of shifts in force.
Minimum 
remuneration.
3. The minimum weekly remuneration payable to all
employees shall be as follows - 
( a ) whole-time employees, other than watchmen/security
guards:
(i) 18 years or over .............................. Lm18.88,0;
(ii) 17 years ...........................................Lm15.97,0;
(iii) 16 years ...........................................Lm14.74,0;
( b ) watchmen/security guards ........................ Lm18.88,0;
Shift premium. 4. Shift employees, other than watchmen/security guards,
shall be paid a premium of Lm1.40,0 a week. 
Minimum daily 
rest.
5. Whole-time employees, other than watchmen/security
guards, shall be allowed intervals for meals and rest of not less, in
the aggregate, than one hour on every day:
Provided that -
( a ) subject to the provisions of paragraph ( b ) of this
proviso, the interval or intervals shall be allowed after
the first or before the last hour of the period of
employment, and
( b ) where the last half hour of the period of employment is
allowed as a half hour of rest, the employee shall be
entitled to leave the place of work as soon as that half
hour starts.

6. Whole-time employees shall be allowed one weekly day of
rest.

7. (1) Watchmen/security guards shall be entitled to overtime
remuneration as follows:
( a ) for all time worked in excess of fifty-four hours up to
and including sixty hours per week .............. time rate; 
( b ) for all time worked in excess of sixty hours per
week ................................................. time-and-a-half; 
Provided that, in the case of watchmen/security
guards working on a shift basis, the said number of
hours shall be calculated by taking the average of the
number of hours spread over two or more weeks

according to the number of shifts in force. 
(2) Shift employees, other than watchmen/security guards,
shall be entitled to overtime remuneration at the rate of time and a
half in respect of all time worked in excess of an average of thirty-
eight hours in any one week, such average to be calculated by
taking the average of the number of hours spread over two or more
weeks according to the number of shifts in force. 
(3) Whole-time employees, other than those specified in sub-
paragraphs (1) and (2) of this paragraph, shall be entitled to over-
time remuneratiom as follows:
( a ) for all time worked in excess of forty hours in any one
week ................................................. time-and-a half; 
( b ) for all time worked in excess of eight hours in any day
other than a Sunday or a customary holiday
.......................................................... time-and-a-half; 
( c ) for all time worked on Sundays ............... double time;
( d ) for all time worked on customary holidays
................. double time in addition to a normal day’s
pay.
Holidays and 
vacation leave.
8. Whole-time employees shall be entitled, in every calendar
year, to -
( a ) all customary holidays with full pay, and
( b ) after three months in employment, vacation leave of
such number of working days with full pay as is
equivalent to the number of working days as that
particular employee should normally attend to work
during a period of four weeks:
Provided that whole-time employees who have
been in employment for less than one year shall be
entitled to such part of the said vacation leave as is in
proportion to the number of months in employment.
Sick leave.

9. (1) After completing six months in employment,
employees shall be entitled to twelve days sick leave on full pay in
every calendar year less any sickness benefit to which they may be
entitled under the Social Security Act, and a further eighteen days
on half pay less half the sickness benefit to which they may be
entitled under the Social Security Act:
Provided that a medical certificate certifying incapacity for
work covering the period of absence is produced, not later than the
second working day of absence, to the employer who shall be
entitled, if he so wishes, to send his own medical officer to examine
the employee.
(2) Notwithstanding the provisions of sub-paragraph (1) of this
paragraph, employees shall not be entitled to the payment of any
wages for the first day of each period of sick leave:
Provided that the number of unpaid days of sick leave shall
not be deducted from the entitlement of paid sick leave as provided

in sub-paragraph (1) of this paragraph.
Bereavment leave. 10. A whole-time employee shall be allowed two calendar days
as special leave without loss of pay, to be taken in succession, on
the occasion of the death, and starting not later than the day
following the death, of any of the following relatives: the wife,
husband, father, mother (or the person who at the time was in fact
acting as the mother or father of the employee), son, daughter,
brother and sister.
Birth leave. 11. A whole-time employee shall be alllowed two working
special leave with pay to be taken within a month from the birth of
a child to the wife of such employee.
Marriage leave. 12. A whole-time employee shall be allowed four working
days special leave with pay on the occasion of his marriage on
condition that he would continue in employment for at least three
months after getting married.
Jury service. 13. A whole-time employee shall, if called upon to serve as
juror, be allowed time off as necessary, without any deduction from
pay to which he would otherwise have been entitled, so as to enable
him to attend to his duties at the Courts.
Injury leave.

14. A whole-time employee shall be entitled to one year injury
leave on full pay less the full amount of any injury benefit to which
such employee may be entitled in terms of the Social Security Act,
if he is injured during the actual discharge of his duty and not due
to contributory negligence on his part or contravention of safety
rules laid down by the management.
Minimum 
remuneration of 
part-time 
employees.
15. Part-time employees shall be entitled to a minimum hourly
rate calculated  pro rata  in accordance with the provisions of
paragraphs 2 and 3 of this Schedule.
Retiring age.  16. In cases where the retiring age of a male employee is
expected at the age of sixty years, such employee shall be given the
opportunity by the employer to retain his employment beyond this
age at least until the age of sixty-one years, provided that the
employee in question shall still be allowed, if he so wishes, to retire
at the age of sixty years.
Walting time. 17. An employee is entitled to the payment of the minimum
remuneration applicable to him for all time during which he is
present on the premises of this employer or any other place in
connection with his employmemt unless he is present thereon in
any of the following circumstances -
( a ) without the employer’s consent, expressed or implied;
( b ) for some purpose unconnected with his work and other
than that of waiting for work to be given to him to
perform;
( c ) by reason only of the fact that he is resident thereon;
( d ) during normal meal times, and he is not waiting for
work to be given to him to perform.

EXPLANATORY NOTE
(This note is not part of the Order but is intended to indicate its
applicability).
The provisions of the above Schedule apply to all employees in
any undertaking or part of an undertaking, the activities of which
consist wholly or mainly in the manufacture, repair or assembly of
electronic or scientific equipment.
