DUPLICATE NOTES AT THE PUBLIC REGISTRY 
REGULATIONS

Making of 
duplicate notes.
2. (1) It shall be the duty of the Director of the Public
Registry to make duplicate notes of any original notes for the
registration of any cause of preference among creditors, notes of
reference or notes of enrolment deposited in the Public Registry in
Malta or in the Public Registry in Gozo, where the original note has
been lost, destroyed or damaged and to make a new register in
substitution of any register lost, destroyed or damaged.
(2) The making of the duplicate notes and new registers shall
be compiled by making reference to the respective register and
original note, as the case may be, kept in the Public Registry or by
reference to the relative deed, and reproducing the relevant
information therein contained on the duplicate note or new register,
as the case may be.
(3) The duplicate notes or new registers may be made by the
process of microfilming, which shall be carried out on the premises
of the Public Registry in Malta and in Gozo and under the
supervision of the pertinent director of that registry.

3. The provisions of the Public Registry Act and of the Civil
Code relating to the formulation of the notes mentioned in these
Regulations shall apply to duplicate notes and new registers made
under these Regulations.

4. (1) The duplicate notes or new registers prepared in
accordance with these Regulations shall be authenticated by the
Director of the Public Registry or by an assistant director or an
officer mentioned in article 3(2) of the Public Registry Act, and the
director or such assistant director or officer abovementioned shall
ensure that the information contained in the duplicate note or new
register conforms to the information contained or which ought to
have been contained in the original note or register.
 (2) The Director of the Public Registry shall indicate the
duplicate notes or new registers which have been made in
accordance with these Regulations and the date and the source
thereof.
Notes of renewals 
of registrations and 
of legal hypothec.
5. The provisions of these Regulations shall also apply to the
making of duplicate notes and new registers of notes of renewals of
registrations and of legal hypothecs.
