THE CENSUS ORDER
29th September, 1995
LEGAL NOTICE 134 of 1995.
Title.
Interpretation. 
"household" means one person living alone or two or more
persons living together and sharing food and the essentials for
living;
"midnight ending the census day" means midnight of the 26th
November, 1995;
"person" means any Maltese citizen ordinarily resident in Malta
and any foreigner who on the midnight ending the census day shall
have been ordinarily resident in Malta for a period of more than
twelve months;
"reference person", in relation to a household consisting of two
or more persons, means -
( a ) either the husband or the wife of a legally married
couple living in the household;
( b ) either spouse in the absence of the other spouse, due to
his/her death, separation, imprisonment or incapacity;
( c ) either partner of a consensual union living in the
household;
( d ) the parent, where a single parent lives with his/her
unmarried children of any age;
(e) where none of the above conditions apply, the most
adult member of the household irrespective of his/her
material contribution to the household’s upkeep and
maintenance;
( f ) in special circumstances such person as in the opinion
of the census officer, is the reference person.

Information for 
purpose of census.
4. Information for the purpose of the census shall be collected
and furnished with respect to:
( a ) all persons who at midnight ending the census day, are
alive and present or, though absent, are ordinarily
resident -
(i) at any place on land within the territory of
Malta;
(ii) on any ship or other vessel lying moored or
anchored within any of the ports of Malta and on

any ship or vessel registered in Malta which is at
that time engaged in any coastal or fishing
voyage; and
( b ) all housing accommodation, facilities and amenities in
Malta.
Persons who are to 
give information.
5.   The information for the purpose of the census shall be
given with regard to the classes of persons mentioned in the first
column of the First Schedule by the persons mentioned opposite
each such class in the second column of that Schedule. Such
persons shall also give the information for the purpose of the
census relating to housing accommodation occupied or held in
tenancy by their households or existing within their institution, ship
or vessel, as the case may be. With regard to vacant housing
accommodation, the information for the purpose of the census shall
be given by such persons as in the opinion of the census officer can
give the requisite information:

Provided that any person present at midnight ending the
census day on the premises specified in paragraphs 2 and 3 of the
first column of the First Schedule may elect in such manner as is
provided by the Census Regulations, to furnish the census
information personally, and in that case the persons mentioned in
paragraphs 2 and 3 of the second column of the First Schedule to
this Order shall furnish only the information set out in paragraphs
1( a ), ( b ) and ( c ) of the Second Schedule.
Particulars to be 
stated.
6. The particulars that may be required to be stated in the case
of persons with respect to whom information is to be given, shall be
those specified in Part I of the Second Schedule, and in the case of
housing accommodation shall be those specified in Part II of the
Second Schedule:
Provided that the particulars that may be required in
respect of persons who are members of religious conventual
communities shall be only those specified in paragraphs 1, 2, 3 and
5 of Part I of the Second Schedule and that no particulars shall be
required in respect of the accommodation occupied by such persons
within the premises of their religious conventual community.

FIRST SCHEDULE
(Article 5)
The persons with respect to whom

1. ( a ) The persons present at
midnight ending the census day in a
dwelling, lodgings or rooms, separately
occupied by any household of which they
are members, guests (including paying
guests or boarders), or employees.

( b ) The persons usually resident
in any such dwelling, lodgings or rooms
but temporarily absent therefrom at
midnight ending the census day.
2. The persons present at midnight
ending the census day on the premises of
any hotel, boarding-house, guest-house,
club, hostel or other common lodging
house.

the time being in charge of the
premises.
3. The persons present at midnight
ending the census day on the premises of
any hospital, nursing home, religious or
charitable community, residential school or
college, civil prisons or other place of
detention, approved or industrial school or
any residential establishment whatsoever
not being an establishment mentioned
elsewhere in this Schedule.
3. The chief resident officer or other
person for the time being in charge of
the hospital, home, community, school,
college, prison, approved or industrial
schools or establishment.
4. The persons present at midnight
ending the census day on the premises of
any military stations.
4. The commanding officer or other
person appointed for the purpose in
pursuance of arrangements made by the
army authorities.
5. The persons present at midnight
ending the census day on any ship or
vessel lying moored or anchored within
any of the ports of Malta or any ship or
vessel registered in Malta engaged in any
coastwise or fishing voyage.
5. The captain, master or other
person for the time being in charge of
the ship or vessel.
6. The persons not included among
any of the classes of persons above
mentioned.
6. The person with respect to whom
the return is to be made.

SECOND SCHEDULE
(Article 6)
Part I
Particulars regarding Persons
1. In respect of every person enumerated -
( a ) full name;
( b ) number of identity card;
( c ) relationship to reference person or status within the institution, ship or
vessel as the case may be;
( d ) sex;
( e ) date of birth;
( f ) whether single, married, separated; divorced or had an annulled
marriage; widowed or remarried;
( g ) citizenship; 
( h ) nationality;
( i ) place of residence.
2. In respect of persons aged 10 years or over -
( a ) whether they can read and write;
( b ) knowledge of languages.
3. In respect of person 16 years or over -
( a ) level of education attained;
( b ) educational qualifications.
4.  In respect of every person -
( a ) whether any activity limitations exist;
( b ) whether any long-term disabilities or handicaps exist; 
( c ) whether covered by a private health insurance policy.
( d ) whether a smoker or non-smoker;
( e ) whether a drinker or non-drinker.
5. In respect of married or widowed Maltese women -
( a ) number of children born living;
( b ) year of first marriage;
( c ) year of birth of first-born child.
6. In respect of every person - 
( a ) his/her place of residence;
( b ) place of his/her residence one year ago; 
( c ) place of his/her residence five years ago; 
( d ) whether the person is a returned migrant.
7. In respect of every person aged 16 years or more -
if at work at any time during week ending 5 November, 1995, stating in
respect of that week -

(i) whether he/she is economically active or not;
(ii) what is his/her status in employment;
(iii) the number of hours worked per week;
(iv) what is his/her current occupation;
(v) what sector, public or private, he/she is employed in and who is
the employer;
(vi) the address of his or her place of work;
(vii) his/her gross income which he/she usually receives each month
from all sources;
(viii) means of transport to place of work or study;
(ix) whether a smoker or non-smoker;
(x) whether a drinker or non-drinker.
Part II
Particulars regarding housing accommodation
8. In respect of every dwelling occupied by one or more households, stating -
( a ) the address and type of dwelling;
( b ) the number of households accommodated in the dwelling, total number
of persons residing therein, and total number of rooms in the dwelling.
9. In respect of each household in the dwelling, stating - 
( a ) the number of persons forming the household;
( b ) the number and classification of rooms;
( c ) whether any member of the household rents, or owns the dwelling
where the household lives, and the amount of rent paid;
( d ) whether the household lives regularly or occupies temporarily the
dwelling; and
( e ) what kind of equipment is used for cooking;
( f ) what kind of equipment/amenities are available; 
(g) what toilet facilities are available;
( h ) what type of sewage disposal system is available;
( i ) what type of bathing facilities are available;
( j ) what type of heating facilities are available;
( k ) what telephone service is installed;
( l ) period of construction of dwelling; 
( m ) other existing amenities/facilities;
( n ) what other information relating to the quality of life;
( o ) whether any member of the household rents or owns a summer
residence.
10. In respect of every vacant housing accommodation, such details as occurring
in paragraphs 8 and 9 of Part I of this Schedule shall  mutatis mutandis  apply.
