PROCEDURES REGULATIONS

Title.
Interpretation.

2. In these regulations, "licence" shall mean a licence to set
up or keep in any place any workshop, or carry on any trade or
business.
Police Licences 
Advisory Board.

3. (1) There shall be constituted a Police Licences Advisory
Board, hereinafter in these Regulations called "the Board", to
advise the Commissioner of Police in respect of all applications for
the grant, renewal and transfer of licences.
(2) The Board shall consist of a president and two members
who shall be appointed for the purpose by the Minister responsible
for the Police for a period of one year.
Board shall also 
hear interested 
party.
4. When an application for the grant, renewal or transfer of a
licence has been contested by any other interested party, the Board
shall hold a sitting to hear on oath both applicant and the interested
party, together with any witness that may be required.
Advice to 
Commissioner of 
Police.
5. (1) The Board shall tender its advice in writing to the
Commissioner of Police concerning the grant, renewal or transfer
of a licence as it deems fit, and it may also advise the imposing of
particular conditions for any licence.
(2) A copy of such advice as is referred to in sub-regulation (1)
of this regulation shall be given forthwith on demand to an
applicant or to an interested party in the case.
Police Licences 
Appeals Tribunal.
6. (1) There shall be constituted a Police Licences Appeals
Tribunal, hereinafter in these Regulations called "the Tribunal", to
hear and determine the final advice to be given to the
Commissioner of Police in respect of a previous decision made by
the same Commissioner in respect of the grant, renewal, transfer or
cancellation of licenses.
(2) The Tribunal shall consist of a president and two assessors
who shall be appointed for the purpose by the Minister responsible
for the Police for a period of two years.
(3) The Tribunal shall hear appeals lodged by any - 
( a ) applicant who contests the decision of the
Commissioner of Police to refuse him a licence, or to
condition the grant, renewal or transfer of a licence, or
to cancel a licence; and
( b ) interested party who would have previously made his
representations before the Board in terms of regulation

4 and who contests the grant, renewal or transfer of a
licence.

7. The Police Licences Advisory Board and the Police
Licences Appeals Tribunal shall regulate their own procedure.
Time limit for 
appeal.
8. An appeal from a decision of the Commissioner of Police
given after the advice of the Board in terms of regulation 5 may be
entered before the Tribunal by means of a letter addressed to the
president thereof at Police Headquarters, Floriana, within twenty-
one days from the service of the decision of the Commissioner of
Police to an applicant or to an interested party as the case may be.
Summoning of

9. (1) Both the Board and the Tribunal shall have power,
exercisable through their presidents -
( a ) to summon witnesses who shall be heard on oath;
( b ) to administer an oath to any witness and to any person
concerned in the case, and require them to give
evidence.
(2) Summonses for attendance of witness may be in such form
as may be appropriate to the case, and shall be signed by the
president of the Board or Tribunal as the case may be.
