FEES LEVIED FOR BUILDING PERMITS 
REGULATIONS
1st January, 1988

Title. 
Permits Regulations.
Fees for issue of 
building permits.
2. Saving the provisions of regulation 3 of these Regulations,
the fees specified in the Schedule hereto shall be payable to the
Planning Authority in respect of the services therein mentioned.
Exemption.
Amended by:

3. No additional fees indicated in item 3 of the Schedule to
these Regulations shall be charged in respect of:
( a ) buildings for religious, cultural or philanthropic
purposes such as churches, convents, political, social
and sports clubs, and schools, and Government other
than parastatal buildings;
( b ) areas roofed with temporary structures and balconies; 
( c ) rooms on roofs, provided these are not intended for
habitation;
( d ) staircases and lift spaces above the top floor;
( e ) home ownership scheme plots and building
development areas allocated before the 31st December,
1987; 
( f ) basements which are not used for habitation under
houses or villas; 
( g ) buildings intended for agricultural purposes such as
tool sheds and farm houses which are the property of
registered full-time farmers; and
( h ) buildings belonging to the Malta Development
Corporation and to the Malta Freeport Corporation
Limited.
General 
considerations.
4. In the assessment of the amount due, the following general
considerations shall be taken:
( a ) The measurement of roofed buildings shall be based
on the occupied area including the thicknesses of
dividing walls and external walls, and half the
thickness of party walls. The area occupied by
courtyards shall be deducted from the measurement.
( b ) Verandahs shall be considered as built areas.
( c ) Staircases, lifts and other common spaces shall be
considered as roofed buildings in respect of each floor.
( d ) For each building which is variably used for different
purposes there shall be paid a fee in respect of each

part of such building as indicated in the Schedule.
Renewal 
applications.
5. An application for the renewal of a permit, filed after the
expiration of the permit and in respect of which the fees specified
in these Regulations were not paid, shall be considered as a new
application unless the work had already been commenced.
Payments. 6. (1) The payment of additional fees indicated in item 3 of
the Schedule shall apply to all applications which were filed after
the 25th November, 1987, but the fee due on the filing of an
application indicated in items 1 and 2 of the Schedule shall not be
paid for those applications filed before the 31st December, 1987.
(2) Payment of the fee on filing of an application shall be
denoted by the fixing of a postage stamp of the relative amount on
the application. The stamp shall be effectively cancelled by the
applicant and rendered incapable of being used for any other
application or purpose. All other payments are to be made at the
cash office of the Department of Works, Block A, Floriana, or at
the Department’s office in Victoria, Gozo, on workdays between 8
a.m. and 12 noon. A receipt will be issued for each payment.
Reimbursements. 7. The fees specified in these Regulations shall not be
reimbursable except for the additional fees indicated in item 3 of
the Schedule to these Regulations in the case of the withdrawal of a
permit.
Transfer of 
permits.
8. An application for the transfer of a permit shall be
considered as a new application, but no additional fees shall be paid
again.

Adjacent houses:
Such houses include houses which have
direct access from the road such as terraced
houses and maisonettes.
(i) For not more than 200 square metres of

For every square metre of roofed building on
each floor there shall be paid a fee equal to
the difference between the fee due for a
permit for the erection of a building for the
use to which the building is to be changed and
the fee which would have been payable had
the building on the date of the application
been constructed for the use being made
thereof before the change.
