PORT DUES REGULATIONS
5th March, 1977

and Act XVII of 1991.
Citation. 
Definitions.
"ton" means, for the purpose of calculating port dues, the net
registered tonnage of a vessel and when a vessel has more than one
net registered tonnage, the higher or highest of such tonnage shall
be the net registered tonnage;
"period of seven days" means any period of seven days
commencing from the day on which a vessel enters a port or on
which a vessel is laid up, as the case may be.
Port dues.
entering any port shall be those specified in the First Schedule.
(2) The port dues to be charged in respect of laid up vessels
shall be those specified in the Second Schedule.

4. Any person who is liable for the payment of the dues
specified in the Schedules shall produce to the Malta Maritime
Authority any documents which he may require to ascertain the
amount of dues payable.
Change of 
ownership of 
vessels.

5. Any change in the ownership of a vessel in a port shall be
notified in writing jointly by the previous owner and the new owner
to the Malta Maritime Authority immediately such change takes
place, and, in the absence of such notification, the previous owner
and the new owner shall be liable  in solidum  for payment of any
dues which in terms of these regulations accrue in respect of the
vessel.
2 ġ S.L.352.06 PORT DUES
1. In this Schedule, unless the context otherwise requires -
"tourist vessel" means any vessel which is specifically and exclusively intended
for use by persons travelling for recreation, pleasure or culture, provided that the
vessel does not discharge or load cargo or mail in a port.
2. Subject to the provisions of this Schedule, every vessel entering any port
shall pay port dues as follows:
3. (1) Notwithstanding the provisions of paragraph 2:
( a ) the dues payable by vessels calling at any port solely for bunkers, stores
or water or for the purpose of engaging or discharging members of the
crew shall be at the rate of seventy-five  per centum  of the dues specified
in the said paragraph 2;
( b ) any vessel in distress calling at any port solely as a part of refuge or for
medical assistance or to land a sick person shall pay no port dues if the
vessel remains thereat for a period not exceeding twenty-four hours, but
thereafter shall pay:
(i) at the rate of fifty-five  per centum  of the dues specified in the said
paragraph 2 if the stay does not exceed forty-eight hours;
(ii) at the full rates specified in the said paragraph 2 if the stay
exceeds forty-eight hours.
( c ) the dues payable by vessels of 2,000 tons or over calling at any port for
the purposes of repairs and which in the opinion of the Malta Maritime
Authority constitute  bona fide  repairs as related to the vessel’s stay in
port, shall be at the rate of eighty  per centum  of the dues specified in the
said paragraph 2;
( d ) the dues payable by tourist vessels ca1ling at any port shall be at the
rate of fifty  per centum  of the dues specified in the said paragraph 2;

Port Dues payable in respect of vessels 
entering a port
( a ) Sailing and auxiliary vessels:
In respect of every period of seven days or part thereof
during which the vessel remains in port -
For every 20 tons or part thereof ............................. Lm 4
( b ) Steam vessels (not exceeding 2,000 tons):
In respect of every period of seven days or part thereof
during which the vessel remains in port -
For every 500 tons or part thereof ........................... Lm 10
( c ) Steam vessels (exceeding 2,000 tons):
In respect of every period of seven days or part thereof
during which the vessel remains in port -
For the first 2,000 tons ........................................... Lm 50
For every 1,000 tons or part thereof in excess of
2,000 tons .............................................................. Lm 5

( e ) the dues payable by vessels calling at any port solely to load locally
produced or manufactured goods for export shall be at the rate of fifty
per centum  of the dues specified in the said paragraph 2;
( f ) the dues payable in respect of vessels registered in Malta shall be
payable only in respect of the first two periods of seven consecutive
days each or part thereof;
( g ) the dues payable by vessels calling at any port to load or unload goods
shall be at the rate of ten  per centum  over the dues specified in the said
paragraph 2:
Provided that this subparagraph shall not be construed as exempting such
vessels from the provisions of the Second Schedule.
(2) The provisions of subparagraph (1)( a ), ( b ), ( c ) and ( d ) shall not apply to any
vessel which loads or unloads any cargo or which embarks or disembarks passengers
other than passengers in transit.
4. No vessel entering a port shall at any one time qualify for more than one of
the rebates specified in paragraph 3, but when such vessel would but for the
foregoing provisions of this paragraph, be entitled to more than one rebate, the most
favourable rebate shall apply.
5. (1) The dues payable by any vessel entering any port and having on board
more than 5 tons gross of explosives, other than safety class explosives, shall be
double the dues specified in paragraph 2.
(2) For the purposes of this paragraph "explosives" and "safety class
explosives" shall have the same meaning as is assigned to them under the Ports
Regulations.
1. (1) Laid-up vessels, whether registered in Malta or otherwise, shall pay port
dues as follows:

( a ) vessels not exceeding 10 tons ........ Lm4.50 per vessel for every
period of seven days or part

( b ) vessels exceeding 10 tons but not

( c ) vessels exceeding 50 tons but not
exceeding 100 tons ....................... Lm13.50 per vessel for every

(2) Laid-up vessels exceeding 500 tons shall pay port dues as follows:
2. If the net registered tonnage of a vessel is not known to or cannot be
established by the Malta Maritime Authority, it may appoint one or more surveyors
at the expense of the person or persons liable to pay port dues to determine the net
registered tonnage of that vessel.
3. Notwithstanding the provisions of paragraph 1, any vessel, whether
registered in Malta or otherwise, which is laid-up without the permission of the
Malta Maritime Authority shall pay the port dues specified in paragraph 1 increased
by one hundred  per centum .
( d ) vessels exceeding 100 tons but not
exceeding 500 tons ....................... Lm18 per vessel for every
