CONTROLLED PARKING SCHEMES (RESIDENTS 
AND COMMERCIAL) REGULATIONS

Citation.
Schemes (Residents and Commercial) Regulations.
Interpretation.
"commercial vehicle" means any vehicle carrying goods of more
than 3.5 tonnes weight and includes any truck, van, pickup,
mechanical horse, trailer, concrete mixer, bowser and crane;
passenger transport vehicles, including any coach, bus, minibus,
mini-van and taxi; car-hire vehicles, whether chauffeur driven or
rented; commercially registered vehicles; towed vehicles, including
boats on a trailer, other trailers and caravans;
"controlled zone" means a zone where the holder of a residents’
permit issued to him in respect of his vehicle by the Local Council
of a locality within which the zone lies, lives, and in respect of
which there apply such parking conditions as are set out in these
regulations;

"Local Council" means a local government council established in
terms of the Local Councils Act, and "Council locality" shall be
construed as a locality governed by a Local Council;
"non-permitted vehicle" means a vehicle which is not a permitted
vehicle in a particular Council locality;
"occupied space" means the space occupied by a non-permitted
vehicle for a restrictive prescribed period as may be indicated in a
controlled zone during a prescribed period and which, along with
any other space within the controlled zone, may not be used again
by the same vehicle during such prescribed period before the expiry
of the corresponding stay-away prescribed period;
"parking disc" means a cardboard device as indicated in the
Fourth Schedule containing a revolving disc which shows, through
a window in the outer cover; a twelve-hour clock with indicators
for segments of 15 minutes each inscribed on the inner disc;
"permitted vehicle" means a vehicle which belongs to or is
normally driven by a person holding a residents’ permit, and which
may be parked without any restriction within normal lawful limits
at any time and for any duration in a controlled zone or zones in
respect of which the residents’ permit is issued;
"prescribed period" means such period as is prescribed in each
controlled zone as relating to -
( a ) the number of minutes a non-permitted vehicle may
park in an occupied space without incurring any
contravention, also referred to as the restrictive

prescribed period;
( b ) the number of minutes such non-permitted vehicle
shall stay away from the occupied space before
returning to the same controlled zone, also referred to
as the stay-away prescribed period;
( c ) the days of the week and the times thereof during
which restricted parking for non-permitted vehicles
applies;
"residents’ permit" means a permit as indicated in the Second
Schedule issued to a resident of a controlled zone in respect of a
registered vehicle, which is not a commercial vehicle or a motor-
cycle, which is owned or driven by such resident, and which
renders his vehicle a permitted vehicle;
"traffic sign" means a traffic sign as indicated in the Third
Schedule and containing the following elements, namely an
indication "P" that the sign relates to parking in a timed parking
zone, indicating the zone, the parking time allowed and the no-
return time, the prescribed period of restricted parking and an
indication that all other days and times are unrestricted, the
kerbside length of the restricted areas, a note about the non-
applicability to particular holders of a residents’ permit of one or
more controlled zones, a graphical representation of the parking/
disc, the coat-of arms of the Local Council or Local Councils of the
locality or localities.
Controlled zones. 3. (1) There may be established any one or more controlled
zones within any Council locality as may be indicated in the First
Schedule within which -
( a ) a resident of such zone to whom a residents’ permit
has been issued in respect of his vehicle as shown in
the Second Schedule, may always park such permitted
vehicle without any restriction as to occupied space
and prescribed periods;
( b ) a resident of such zone to whom a residents’ permit
has been issued in respect of his vehicle as shown in
the said Second Schedule, may always park such
permitted vehicle either within such zone or any other
zone within the same Council locality without any
restriction as to occupied space and prescribed
periods;
( c ) the driver of a non-permitted vehicle may not park
such vehicle during any prescribed period indicated in
the said First Schedule and as shown in a traffic sign
as indicated in the Third Schedule unless he abides by
the provisions of these regulations.
(2) The driver of any motor-cycle, whether such vehicle
pertains to the holder of a residents’ permit or not, may always park
his vehicle within a zone in an unrestricted manner.
Residential permit. 4. (1) The Local Council shall issue a residents’ permit to
those  bona fide  residents and owners of validly registered vehicles
residing in a controlled zone within the Council locality that satisfy

the criteria for eligibility established by an  ad hoc  order of either
the Minister responsible for transport or the Minister responsible
for local government duly communicated to the Local Council or
the Local Councils.
(2) Such permit, as indicated in the Second Schedule, shall
essentially indicate the coat-of arms and the locality of the Local
Council issuing it, the registration number of the permitted vehicle
and the controlled zone or zones for which it is applicable. A
permit number shall also be included.
(3) The residents’ permit shall be fixed close to the road
licence on the left-hand side of the windscreen of the vehicle
having the same registration number as that shown on the permit.
(4) For the purposes of these regulations a resident is the
owner or driver of a vehicle living in premises within a controlled
zone for 186 days or more in a year, being the premises normally
declared as such in the current electoral register.
(5) Upon proof being given that a person who has not received
a permit is a  bona fide  resident of a controlled zone and satisfies
the criteria duly established as prescribed in subregulation (1), the
Local Council shall forthwith issue him with a permit.
(6) A residents’ permit shall be valid for two years, and it may
be renewed at the Licensing and Testing Department at any time
after its expiry together with the road licence when its renewal is
next due.
(7) For the purpose of these regulations, a disabled person’s
Blue Sticker issued by the National Commission Persons with
Disability, or any other internationally recognised signs indicating
a disability, shall be considered to be equivalent to a residents’
permit.
Parking of non-
permitted vehicles.

5. Subject to the provisions of regulations 78 to 80 of the
Motor Vehicles Regulations, no person shall park any motor
vehicle in a controlled zone within the prescribed period unless -
( a ) such vehicle is a permitted vehicle whose owner or
driver has a valid residents’ permit issued by the Local
Council of a locality where such owner or driver
resides, and such permit is fixed on the left-hand side
of the windscreen in such a position as to be visible
from the front;
( b ) such person driving or owning a non-permitted vehicle
conforms with the specific provisions for a controlled
zone as may be indicated in the First Schedule, on a
traffic sign and on the backside on the outer cover of
the parking disc.
Use of parking 
disc.
6. (1) Whenever the driver of a non-permitted vehicle parks
such vehicle within a controlled zone, whether during a prescribed
period or at any other time, he shall set the revolving disc clock
indicator of his parking disc to show as correctly as possible the
time of his leaving the vehicle parked in an occupied space.
(2) The parking disc, as portrayed in the Fourth Schedule,

shall be displayed on the surface of the dashboard in a clear and
visible position from the outer side the windscreen.
(3) A non-permitted vehicle shall not remain parked during a
prescribed period for a time exceeding the restrictive prescribed
period indicated in the First Schedule for such controlled zone and
shown on the traffic sign affixed in the area.
(4) A non-permitted vehicle shall not return to the same
controlled zone during a prescribed period for a time exceeding the
stay-away prescribed period indicated in the First Schedule for
such controlled zone and shown on the traffic sign affixed in the
area.
(5) Such driver or owner of the non-permitted vehicle shall
also conform fully with the instructions given on the backside of
the outer cover of the parking disc.
Offences. 7. Any person who, during a prescribed time and in a
controlled zone -
( a ) parks or is the owner of a permitted vehicle which is
parked and on which a residents’ permit for that zone
or any other permitted zone, a Blue Sticker issued by
the National Commission Persons with Disability, or
any other internationally recognised sign indicating a
disability, are not clearly displayed, or
( b ) parks or is the owner of a non-permitted vehicle which
is parked and inside which a parking disc is not clearly
displayed, or
( c ) parks or is the owner of a vehicle which is parked and
on which neither any valid residents’ permit nor a
parking disc are displayed, or
( d ) parks or is the owner of a non-permitted vehicle which
is parked and has an incorrect parking time indicated
on the parking disc, or
( e ) parks or is the owner of a non-permitted vehicle which
is parked for a period exceeding the restrictive
prescribed period, or
( f ) returns to park or is the owner of a non-permitted
vehicle which is again parked in the same controlled
zone within the stay-away prescribed period,
shall be guilty of an offence and shall, on conviction, be liable to a
fine ( ammenda ) of not less than ten liri and not exceeding twenty-
five liri for any of the offences mentioned in this regulation.

Zone A: The dense village core around It-Tokk, excluding I ċ- Ċittadella and
covering the area enclosed by Triq San’ Ursola, Triq il-Kappillan Hili (Fontana),
Pjazza San Fran ġisk, Triq Putirjal and Triq il-Kapuccini.
Zone B: The area covering zone A but also excluding I ċ- Ċittadella.
