BOARD OF THE HOSPITAL FOR MENTAL 
DISEASES REGULATIONS 
4th February, 1947
GOVERNMENT NOTICE 59 of 1947, as amended by Legal Notices 53 of
1962 and 60 of 1964.

1. The title of these Regulations is Board of the Hospital for
Mental Diseases Regulations.
Constitution of the 
Board.

2. There shall be a Board for the Hospital for Mental Diseases
which shall consist of the Chief Government Medical Officer, the
Resident Physician Superintendent of the hospital, the Professor of
Criminal Law at the University of Malta, six physicians of whom
three shall be the psychiatrists at the Hospital and another member
who is not a physician; the last mentioned seven members to be
appointed by the Minister responsible for the Department of Health
annually or as vacancies occur.
Appointment of 
medical member.
3. No person shall be appointed a medical member unless he
is a practising physician of at least five years’ standing.
Minister may 
appoint additional 
members.
4. The Minister responsible for the Department of Health may
appoint additional members to serve on the Board for any special
purpose or for any limited period of time.
Secretary.
Board to meet once 
a week.
6. The Board shall meet once a week at the hospital.

Board.

7. The Chief Government Medical Officer shall be the
Chairman of the Board and, in his absence, the Resident Physician
Superintendent of the hospital shall preside.
Quorum.
shall be present at least five members, provided that, in cases of
urgency, it shall be lawful for the Board to decide by a majority of
the members present.
Disqualification.

Decisions by 
majority of votes.
10. The decisions of the Board shall be taken by a majority of
votes. The Chairman shall have both an original and, in the event of
an equality of votes, a casting vote.
Minutes of the 
proceedings.
11. Minutes of the proceedings of every meeting shall be kept
by the secretary and shall be read at the commencement of the
following sitting. They shall be accessible to the members at all
times.
Board to examine 
patients.
12. The Board shall examine patients admitted during the
preceding week and decide if they should undergo treatment or
otherwise in the hospital. This regulation shall not apply to persons
admitted by order of a court to be kept under observation in the
hospital.

Board to order 
discharge of any 
patient.
13. The Board shall order the discharge of any patient who is
considered to have been cured or who in its judgment may be
allowed to leave the hospital under such conditions as it may
consider necessary. In the case of persons under treatment in the
hospital by order of a court, the Board may, whenever it considers
that any such person is fit to be discharged, make a
recommendation to this effect to the Minister responsible for the
Department of Health.
Inspection by the 
Board.
14. The Board shall visit one or more sections of the hospital at
each meeting and shall enter a record of every inspection in the
minutes of its proceedings.
Fees.  15. Every member of the Board other than officers whose
whole time is at the disposal of the Government, shall be paid a fee
of fifty cents for each meeting of the Board which he attends.
