ATT DWAR IL-PROMOZZJONI TA’ 
PRODOTTI LOKALI
Biex jipprovdi għal miżuri dwar il-promozzjoni tal-bejgħ ta’ oġġetti
Maltin fis-suq lokali, biex jiskoraġġixxi d-dumping u dwar ħwejjeġ oħra li
għandhom x’jaqsmu ma’ dan.

"oġġetti importati" għandha l-istess tifsir mogħti lilha fl-
Ordinanza, iżda ma tinkludix oġġetti prodotti f’dawn il-gżejjer li
jiġu esportati minnhom u wara jiġu mportati fihom;
"oġġetti Maltin" tfisser dawk l-oġġetti li huma għal kollox
mibnijin, prodotti, manifatturati jew proċessati f’Malta jew li tkun
saritilhom binja, produzzjoni, manifattura jew proċessar in parti
f’Malta; "binja, produzzjoni jew manifattura jew ipproċessar in
parti f’Malta" tfisser ix-xogħol li jsir f’Malta fuq oġġetti mportati,
li l-valur tiegħu, li ma jkunx anqas minn ħmistax fil-mija tal-valur
tal-prodott lest, jikkostitwixxi fil-fehma tal-Ministru sehem
raġonevoli tal-valur ta’ l-oġġetti mitmumin;

3. (1) Għandu jitwaqqaf bord, li jkun magħruf bħala l-Bord
għall-Promozzjoni ta’ Prodotti Lokali, li jkun magħmul kif ġej:
(a) chairman li jinħatar mill-Ministru;
(b) żewġ rappreżentanti tad-Direttur, li wieħed minnhom
ikun membru tal-Laboratorju ta’ Standards tad-
Dipartiment ta’ l-Industrija;
(ċ) rappreżentant tad-Direttur tal-Kummerċ; 
(d) rappreżentant tal-Kontrullur tad-Dwana; 
(e) rappreżentant tad-Direttur Ġenerali għall-Ippjanar
Ekonomiku;
(f) rappreżentant tad-Direttur ta’ l-Agrikoltura;
(g) rappreżentant tal-Korporazzjoni Maltija ta’ l-Iżvilupp; 
(h) rappreżentant ta’ organizzazzjoni mwaqqfa biex iġġib
’il quddiem l-esportazzjoni ta’ oġġetti Maltin.
(2) Il-Ministru għandu jaħtar uffiċjal pubbliku li ma jkunx taħt
il-grad ta’ prinċipal anzjan, biex ikun segretarju eżekuttiv tal-Bord. 
(3) Il-membri tal-Bord għandhom jinħatru mill-Ministru wara
li jikkonsulta lill-korp jew persuna li dawk il-membri jkunu ser
jirrappreżentaw fil-Bord.
(4) Il-Bord jista’ jaġixxi minkejja kull vakanza fl-għamla
tiegħu u għandu, bla ħsara għad-disposizzjonijiet ta’ dan l-Att,
jirregola l-proċedura tiegħu stess.

4. (1) Il-Bord għandu dawn il-funzjonijiet li ġejjin:
(i) li jagħti parir lill-Ministru dwar il-politika li
għandha tiġi segwita fit-twettieq ta’ dan l-Att u
fl-eżerċizzju ta’ xi setgħa li għandu l-Ministru
jew mogħtija lill-Ministru skond dan l-Att;
(ii) li jirċievi u jikkunsidra applikazzjonijiet bil-
miktub minn kull persuna jew organizzazzjoni
dwar l-introduzzjoni, l-emenda jew ir-revoka ta’
miżuri li jistgħu jittieħdu mill-Ministru skond
dan l-Att għall-promozzjoni ta’ oġġetti Maltin u
jagħmel rakkomandazzjonijiet dwarhom lill-
Ministru;
(iii) li jagħmel rakkomandazzjonijiet lill-Ministru
dwar l-introduzzjoni, l-emenda jew ir-revoka ta’
miżuri li jistgħu jittieħdu mill-Ministru skond
dan l-Att, għall-promozzjoni ta’ oġġetti Maltin
ukoll meta ma tkun saret ebda applikazzjoni
dwar dan skond il-paragrafu (ii).
(2) Il-Bord għandu, fi żmien ġimgħatejn jippubblika avviż
f’termini ġeneriċi fil-Gazzetta dwar l-applikazzjonijiet kollha li
jkun irċieva skond is-subartikolu (1)(ii) kif ukoll dwar kull
suġġeriment li jkun ser jagħmel il-Bord innifsu, sabiex jintroduċi,
jemenda jew jirrevoka miżuri li jistgħu jittieħdu taħt dan l-Att
għall-promozzjoni ta’ oġġetti Maltin, b’mod li jagħti lill-persuni
jew lill-organizzazzjonijiet interessati perjodu ta’ mhux inqas minn

tliet ġimgħat sabiex jagħmlu s-sottomissjonijiet tagħhom bil-
miktub fuq l-applikazzjonijiet jew suġġerimenti msemmija qabel.
(3) Il-Bord għandu mhux aktar tard minn tliet xhur minn tmiem
il-perjodu imsemmi fis-subartikolu (2), jissottometti lill-Ministru
ir-rakkomandazzjonijiet tiegħu dwar il-miżuri li jkunu qegħdin jiġu
proposti li jittieħdu, jew li jiġu emendati jew revokati u dwar kull
sottomissjoni bil-miktub li jista’ jkun irċieva.
(4) Minkejja d-disposizzjonijiet tas-subartikolu (3) il-Ministru
jista’, b’avviż fil-Gazzetta, itawwal iż-żmien li fih il-Bord għandu
jissottometti r-rakkomandazzjonijiet tiegħu.
(5) Id-Direttur għandu -
(i) jżomm dik id-dokumentazzjoni dwar dawk l-
oġġetti Maltin u tal-miżuri meħudin taħt dan l-
Att għall-promozzjoni tagħhom, kif il-Ministru
jista’ jordna minn żmien għal żmien; u
(ii) jassigura li tkun qegħda titwettaq u jara kemm
tkun effettiva xi miżura li tista’ tittieħed mill-
Ministru bis-saħħa ta’ dan l-Att, u sabiex
jagħmel rakkomandazzjoni dwar dan lill-
Ministru.

5. (1) Liċenza għall-importazzjoni ta’ l-oġġetti elenkati fl-
Ewwel Skeda tista’ tiġi maħruġa mill-Ministru responsabbli għall-
kummerċ jekk l-applikazzjoni relattiva tkun ġiet approvata mill-
Ministru:
Iżda dan is-subartikolu ma għandux japplika għal dik l-
importazzjoni kif imsemmija fit-Tieni Parti ta’ l-Ewwel Skeda.
(2) Il-Ministru għandu mhux iżjed tard mit-tieni ġimgħa ta’
kull xahar jippubblika fil-Gazzetta lista ta’ liċenzi approvati minnu
skond id-disposizzjonijiet ta’ qabel ta’ dan l-artikolu, li fiha jindika
l-isem tal-persuna, u meta dik il-persuna tkun qed tidher għal
soċjetà  jew ditta, isem is-soċjetà  jew ditta, li favuriha l-liċenza tkun
ġiet approvata, il-prodott jew il-prodotti li dwarhom tkun approvata
l-kwantità  tagħhom, il-pajjiż ta’ l-oriġini tagħhom u ż-żmien li
matulu jkunu jistgħu jiġu mpurtati.
(3) Il-Ministru jista’ b’regolamenti li jsiru taħt dan l-Att,
jemenda jew jirrevoka l-Ewwel Skeda li tinsab ma’ dan l-Att.
Kap. 117. 
(4) Is-setgħat tal-Ministru responsabbli għall-kummerċ u tad-
Direttur tal-Kummerċ taħt l-Att dwar il-Provvisti u s-Servizzi u
kull regolamenti li jsiru taħt dak l-Att, safejn jirreferu għall-oġġetti
Maltin simili għal dawk elenkati fl-Ewwel u fit-Tieni Skedi ta’ dan
l-Att għandhom jitwettqu mill-Ministru:
Iżda sa dak iz-żmien li l-Ministru jkun jeżerċita dawk is-
setgħat rigward xi prodott partikolari, il-Ministru responsabbli
għall-kummerċ u d-Direttur tal-Kummerċ għandhom jibqgħu
jeżerċitaw is-setgħat imsemmija qabel fir-rigward ta’ dak il-
prodott.
Kap. 324.
Funzjonijiet minn Ministri, il-Ministru jista’ jiddelega kwalunkwe
poter li hu jista’ jeżerċita bis-saħħa tas-subartikolu (4) lid-Direttur

minbarra l-poter li jagħmel regolamenti.
Kap. 117. 
(6) Bla ħsara għad-disposizzjonijiet tas-subartikoli ta’ qabel ta’
dan l-artikolu u ta’ l-Att dwar il-Provvisti u s-Servizzi, il-Ministru
jista’ jippreskrivi permezz ta’ regolamenti illi l-piena għal xi ksur
tad-disposizzjonijiet ta’ l-imsemmi Att jew tar-regolamenti li jsiru
skond dak l-Att u msemmijin fis-subartikolu (3) dwar oġġetti
msemmijin fl-Ewwel Skeda li tinsab ma’ dan l-Att, u għal kull ksur
ta’ l-imsemmi Att u regolamenti li jkunu saru skond dak l-Att dwar
l-oġġetti Maltin imsemmija fis-subartikolu (4), għandha tkun dik il-
piena ta’ mhux iżjed minn multa ta’ ħamest elef lira jew priġunerija
għal żmien ta’ mhux iżjed minn sitt xhur jew dik il-multa u
priġunerija flimkien, hekk kif il-Ministru jista’ jippreskrivi.

6. (1) Għandu jinġabar mill-Kontrullur f’isem il-Gvern,
imposta skond ir-rati relattivi murijin fit-tielet kolonna ta’ l-ewwel
parti tat-Tieni Skeda, dwar l-oġġetti mportati murijin fit-tieni
kolonna ta’ l-ewwel parti tat-Tieni Skeda qabel ma dawk l-oġġetti
jiġu rilaxxati mill-Kontrullur għall-użu jew konsum f’Malta.
(2) Il-Kontrullur għandu, dwar il-ġbir u l-protezzjoni ta’ l-
imposta imsemmija fis-subartikolu (1), ikollu l-istess setgħat u
jsegwi l-istess proċeduri hekk kif skond xi liġi oħra jistgħu
jitwettqu u jiġu segwiti mill-Kontrullur dwar il-ġbir u l-protezzjoni
ta’ dazji ta’ l-importazzjoni jew tad-dwana.

(3) Mingħajr ħsara għall-ġeneralità  tas-subartikolu (2), id-
disposizzjonijiet ta’ l-artikolu 4(6) ta’ l-Att dwar id-Dazji ta’
Importazzjoni, jew ta’ kull provvediment simili li jista’ jkun iseħħ
minn żmien għal żmien dwar oġġetti ta’ xorta mhux kummerċjali li
ma jkunux spirti, tabakk jew prodotti tat-tabakk li jiġu riċevuti
minn persuni individwali, jew importati minn vjaġġaturi fil-valiġġa
tagħhom għandhom ikunu japplikaw daqslikieku r-riferenza f’dak
l-Att għal dazju ta’ importazzjoni kienet daqstant riferenza għall-
imposta.
(4) Meta l-imposta tittieħed ad valorem jew skond il-piż, il-
valur jew il-piż, skond il-każ, ta’ l-oġġetti mportati għandu jiġi
stabbilit bl-istess mod kif indikat minn xi liġi li tkun dak iż-żmien
fis-seħħ, dwar kif għandu jiġi stabbilit il-valur jew il-piż ta’ oġġetti
għall-fini tal-ħlas ta’ dazju ta’ l-importazzjoni.
(5) Fil-ġbir ta’ l-imposta taħt dan l-Att il-Kontrullur jista’
jikkalkola lejn l-eqreb lira kull ammont ta’ imposta.
(6) L-importazzjoni ta’ oġġetti li fuqhom tkun trid titħallas
imposta skond ma hawn f’dan l-artikolu għandha għall-finijiet
kollha ta’ kull liġi titqies li hi projbita jew ristretta sakemm ma
titħallasx jew tiġi eżentata dik l-imposta skond id-disposizzjonijiet
ta’ dan l-Att.

7. (1) Kull min ikun ħati ta’ reat kontra d-disposizzjonijiet ta’
l-artikolu 18, jew ta’ xi wieħed mill-paragrafi (a) sa (k) jew il-
paragrafu (m) ta’ l-artikolu 62 ta’ l-Ordinanza dwar xi oġġetti li
huma suġġetti għal imposta skond id-disposizzjonijiet ta’ dan l-Att,
ikun, b’żieda ma’ kull responsabbiltà  oħra taħt l-Ordinanza jew xi
liġi oħra, ħati ta’ reat kontra dan l-Att u meta jinsab ħati jista’ jeħel

multa ta’ mhux inqas minn ħames mitt lira u mhux iżjed minn
ħamest elef lira jew priġunerija għal żmien ta’ mhux iżjed minn sitt
xhur jew għal dik il-multa u priġunerija flimkien.
(2) Id-disposizzjonijiet ta’ l-artikoli 63, 63A u 77 ta’ l-
Ordinanza għandhom japplikaw għal oġġetti suġġetti għal imposta
taħt dan l-Att daqslikieku kull riferenza li tinsab fl-Ordinanza
għad-dazju msemmi fl-Ordinanza kienu wkoll riferenza għall-
imposta li tittieħed taħt dan l-Att.
Rifużjoni ta’ l-
imposta. 
8. (1) Ma ssirx rifużjoni ta’ xi imposta mħallsa fuq oġġetti li
ma jiġux rilaxxati mill-Kontrullur ħlief jekk:
(a) jintwera għas-sodisfazzjoni tal-Kontrullur li dawk l-
oġġetti ma kienux tniżżlu Malta; jew
(b) ir-rilaxx ta’ l-oġġetti ikun qed jinżamm milli jsir
mingħajr ebda ħtija ta’ l-importatur.
(2) Kull talba għar-rifużjoni ta’ imposta għandha ssir bil-
miktub fi żmien sentejn minn meta titħallas.

9. (1) Il-Ministru jista’ jeżenta persuna mill-ħlas kollu jew
minn parti mill-ħlas ta’ l-imposta dovuta fuq xi oġġetti mportati
minnu, kif suġġett għal dawk il-kondizzjonijiet li l-Ministru jista’
jqis xieraq li jimponi.
(2) L-importazzjoni ta’ l-oġġetti msemmija fit-Tieni Parti tat-
Tieni Skeda minn dawk il-persuni, fejn hu l-każ, imsemmija fl-
istess Parti ta’ l-istess Skeda għandhom jitqiesu li ġew eżentati
skond is-subartikolu (1).
(3) Bla ħsara għas-subartikolu (2), il-Ministru għandu mhux
iżjed tard mit-tieni gimgħa ta’ kull xahar jippubblika fil-Gazzetta
1-eżenzjonijiet, kemm totali u kemm parzjali, li jingħataw taħt is-
subartikolu (1).

10. Il-Ministru jista’ b’regolamenti jemenda t-Tieni Skeda:

11. Il-Ministru jista’ jagħmel regolamenti li jagħmlu
disposizzjonijiet għat-twettiq aħjar tad-disposizzjonijiet ta’ dan l-

b’dawk ir-regolamenti:
(a) jippreskrivi dak kollu li jista’ jiġi preskritt skond kull
disposizzjoni ta’ dan l-Att;
(b) jippreskrivi l-formuli li għandhom jiġu wżati għal xi
finijiet ta’ dan l-Att;
(ċ) jipprovdi għall-immarkar ta’ oġġetti importati li
jistgħu jkunu suġġetti għal imposta, jew li l-
importazzjoni tagħhom hija ristretta skond id-
disposizzjonijiet ta’ dan l-Att jew li għalihom hemm
riferenza f’dan l-Att;
(d) jippreskrivi l-ħlas li għandu jsir għall-immarkar ta’
oġġetti jew għal kull servizz li jista’ jingħata taħt dan

l-Att;
(e) jippreskrivi dik l-informazzjoni li għandha tiġi nkluża
fuq il-fatturi jew dokumenti oħra ta’ importazzjoni li

imposta, jew li l-importazzjoni tagħhom hija ristretta
skond id-disposizzjonijiet ta’ dan l-Att jew li għalihom
hemm riferenza f’dan l-Att;
(f) jippreskrivi l-piena li persuna tista’ teħel meta tikser xi
disposizzjoni ta’ xi regolamenti li jsiru taħt dan l-Att;
b’dana illi dik il-piena ma tistax teċċedi multa ta’
mhux iżjed minn elf lira jew priġunerija għal żmien ta’
mhux iżjed minn xahar jew dik il-multa u priġunerija
flimkien.

12. (1) Proċedimenti kriminali taħt dan l-Att jew taħt id-
disposizzjonijiet tal-liġijiet jew regolamenti msemmijin fl-artikoli
5 jew 7 meta s-setgħat taħt dawk il-liġijiet jew regolamenti jkunu
eżerċitati mill-Ministru għandhom isiru f’isem id-Direttur fil-Qorti
tal-Maġistrati (Malta) jew fil-Qorti tal-Maġistrati (Għawdex) skond
id-disposizzjonijiet tal-Kodiċi Kriminali li jirregolaw il-proċeduri
quddiem il-qorti imsemmija bħala qorti ta’ ġudikatura kriminali.
(2) Il-proċedimenti kriminali imsemmijin fis-subartikolu (1)
għandhom isiru fi żmien sentejn mid-data meta jsir ir-reat.
(3) Minkejja d-disposizzjonijiet tal-Kodiċi Kriminali l-Avukat
Ġenerali dejjem ikollu jedd ta’ appell quddiem il-Qorti ta’ l-Appell
Kriminali minn kull deċiżjoni mogħtija mill-Qorti tal-Maġistrati
(Malta) jew mill-Qorti tal-Maġistrati (Għawdex) dwar
proċedimenti kriminali msemmija fis-subartikolu (1).

SECOND PART
1. All kinds of diabetic products such as jellies, wafers,
biscuits, pasta and other similar products.
2.  Baby products such as foods, clothing and footwear.
3.  Gluten-free, gluten enriched and/or low protein products.
4.  Special shoes and boots used by persons suffering from
muscular or orthopaedical malfunctions.
5.  Imports by:-
( a ) Central Bank of Malta;
( b ) Malta Development Corporation;
( c ) Enemalta Corporation;
( d ) Maltacom plc;
( e ) Deutsche Welle Company for the exclusive use of
operation and maintenance of the Relay Station in
Malta;

( f ) Any imports falling under Section 11 of the
Diplomatic Immunities and Privileges Act.
Cap. 337.
6. Goods and articles exempt from Customs duty as provided
for under Part II of the Second Schedule to the Import Duties Act,
and specified hereunder:-
( a ) Any dutiable article imported by the Government for
the public service;
( b ) Articles which are shown to the satisfaction of the
Comptroller of Customs to have been awarded abroad
to any person for distinction in art, literature, science
or sport, or for public service, or otherwise as a record
of meritorious achievement or conduct, and imported
by or on behalf of that person;
( c ) Articles imported by the University of Malta for the
equipment and maintenance of the University;
( d ) Articles and materials imported by Malta Drydocks for
the equipping and the maintenance of the Dockyard, or
which are required in connection with the services
rendered by that Corporation, other than articles and
materials used in:
(i) goods produced by that Corporation and
intended to be disposed of in Malta, or;
 (ii) locally registered ships which are themselves
subject to duty under the Customs Tariff;
 ( e ) Bona fide  gifts of a non-commercial nature received
occasionally by a person from another person residing
abroad and being intended for the personal use of the
consignee and his family, provided the gift is neither
alcohol nor alcoholic beverage nor tobacco or tobacco
products and the total CIF value of the gifts on every
single occasion does not exceed twenty-five liri;

( f ) Household and personal effects, furniture and other
domestic articles (excluding firearms and weapons of
all kinds) , which in the opinion of the Comptroller of
Customs have been in use within that household by the
importing person or his family, and are imported by
such person on removing his household from another
country to Malta provided that such articles are
imported within six months from the date of arrival in
Malta of the person importing them to take up
residence in Malta, or within such other period which
the Comptroller of Customs may allow;
( g ) Passengers’ baggage, including wearing apparel and
personal effects, used, which the Comptroller of
Customs is satisfied are intended for the passengers’
personal use but excluding firearms and weapons of all
kinds.

7. Furniture, equipment and other material required and
imported by an Offshore company for its own use and the use of
personal belongings of any officer or employee of the company, not
resident in Malta, in terms of subsection (2) of section 33 of the
Malta Financial Services Centre Act.

8. Food and drink for the use of mendicant religious orders
and of private charitable institutions recognised as such by the
Minister as defined by Import Duties Act.
